合同中是怎樣規定試用期的呢?
問 我前幾天面試(shi)上了一家公司,試(shi)用(yong)期三(san)個(ge)月,工資(zi)沒有具體規定(ding),合(he)同(tong)中(zhong)是怎(zen)樣規定(ding)試(shi)用(yong)期的?
答 試(shi)用(yong)(yong)(yong)期包含在勞動合(he)(he)同(tong)期限內。勞動合(he)(he)同(tong)期限三(san)個月(yue)以上(shang)不(bu)滿(man)一(yi)(yi)年(nian)的(de)(de),試(shi)用(yong)(yong)(yong)期不(bu)得(de)超(chao)過(guo)一(yi)(yi)個月(yue);勞動合(he)(he)同(tong)期限一(yi)(yi)年(nian)以上(shang)不(bu)滿(man)三(san)年(nian)的(de)(de),試(shi)用(yong)(yong)(yong)期不(bu)得(de)超(chao)過(guo)二個月(yue);三(san)年(nian)以上(shang)固定期限和無固定期限的(de)(de)勞動合(he)(he)同(tong),試(shi)用(yong)(yong)(yong)期不(bu)得(de)超(chao)過(guo)六個月(yue)。同(tong)一(yi)(yi)用(yong)(yong)(yong)人單位(wei)與同(tong)一(yi)(yi)勞動者(zhe)只(zhi)能約(yue)定一(yi)(yi)次試(shi)用(yong)(yong)(yong)期。勞動者(zhe)在試(shi)用(yong)(yong)(yong)期的(de)(de)工資(zi)(zi)不(bu)得(de)低(di)(di)(di)于(yu)本(ben)單位(wei)相同(tong)崗(gang)位(wei)最(zui)低(di)(di)(di)檔(dang)工資(zi)(zi)或者(zhe)勞動合(he)(he)同(tong)約(yue)定工資(zi)(zi)的(de)(de)百分之八十(shi),并不(bu)得(de)低(di)(di)(di)于(yu)用(yong)(yong)(yong)人單位(wei)所在地(di)的(de)(de)最(zui)低(di)(di)(di)工資(zi)(zi)標準。
