與上司不合被調職,公司這么做合理嗎?

問(wen) 最近我(wo)與上(shang)司鬧得比較(jiao)僵,甚至驚(jing)動了老板(ban),我(wo)突(tu)然(ran)被公(gong)司調職,公(gong)司這么做合理嗎?

一(yi)般(ban)情(qing)況下,公司(si)有權決定(ding)(ding)(ding)調整(zheng)職員(yuan)工作崗(gang)位,但前(qian)提是(shi)該工作崗(gang)位與(yu)獎金(jin)數(shu)額未寫入合同(tong)(tong)(tong)之(zhi)中。依據《勞動(dong)(dong)合同(tong)(tong)(tong)法》第三條二(er)款規定(ding)(ding)(ding):依法訂(ding)立的(de)勞動(dong)(dong)合同(tong)(tong)(tong)具(ju)有約(yue)束力,用人單位與(yu)勞動(dong)(dong)者應當(dang)履行勞動(dong)(dong)合同(tong)(tong)(tong)約(yue)定(ding)(ding)(ding)的(de)義(yi)務。如果(guo)未經勞動(dong)(dong)者同(tong)(tong)(tong)意,單位擅自變更勞動(dong)(dong)者崗(gang)位及獎金(jin)數(shu)額,屬于變更了勞動(dong)(dong)合同(tong)(tong)(tong)內(nei)容的(de)一(yi)種違約(yue)行為。
