試用期與實習期有什么區別?

現在一家公司(si)實(shi)習,我想以(yi)后(hou)留在這個公司(si),可是以(yi)后(hou)還有(you)試用期,試用期與實(shi)習期有(you)什(shen)么(me)區別?

  一(yi)、當(dang)(dang)事(shi)人(ren)(ren)的(de)(de)(de)(de)(de)身份不(bu)同(tong)(tong)(tong)。處(chu)于(yu)試(shi)用(yong)(yong)期(qi)(qi)(qi)中(zhong)的(de)(de)(de)(de)(de)自然(ran)人(ren)(ren)一(yi)方(fang)只能(neng)是(shi)勞(lao)動(dong)者(zhe);而處(chu)于(yu)實習期(qi)(qi)(qi)間的(de)(de)(de)(de)(de)自然(ran)人(ren)(ren)一(yi)方(fang)是(shi)在(zai)校學(xue)生(sheng)。   二、 權利(li)(li)義務關(guan)系不(bu)同(tong)(tong)(tong)。試(shi)用(yong)(yong)期(qi)(qi)(qi)的(de)(de)(de)(de)(de)當(dang)(dang)事(shi)人(ren)(ren)雙方(fang)存在(zai)著勞(lao)動(dong)關(guan)系,用(yong)(yong)人(ren)(ren)單位(wei)對勞(lao)動(dong)者(zhe)承擔無過(guo)(guo)錯責任(ren),與(yu)勞(lao)動(dong)者(zhe)共(gong)同(tong)(tong)(tong)履行(xing)繳納(na)社會保險(xian)費用(yong)(yong)的(de)(de)(de)(de)(de)義務,向勞(lao)動(dong)者(zhe)支付的(de)(de)(de)(de)(de)工(gong)資報酬不(bu)得(de)低于(yu)當(dang)(dang)地最低工(gong)資標(biao)準(zhun)。而學(xue)生(sheng)實習所(suo)在(zai)的(de)(de)(de)(de)(de)單位(wei)對于(yu)實習學(xue)生(sheng),不(bu)承擔無過(guo)(guo)錯責任(ren),不(bu)須執行(xing)最低工(gong)資標(biao)準(zhun)。   三、主(zhu)體間的(de)(de)(de)(de)(de)關(guan)系依據(ju)不(bu)同(tong)(tong)(tong)。用(yong)(yong)人(ren)(ren)單位(wei)與(yu)勞(lao)動(dong)者(zhe),包括(kuo)在(zai)試(shi)用(yong)(yong)期(qi)(qi)(qi)的(de)(de)(de)(de)(de)權利(li)(li)義務關(guan)系由(you)勞(lao)動(dong)法及其相(xiang)關(guan)規(gui)定進行(xing)規(gui)范,如勞(lao)動(dong)合(he)同(tong)(tong)(tong)期(qi)(qi)(qi)限(xian)在(zai)6個月以內(nei)的(de)(de)(de)(de)(de),試(shi)用(yong)(yong)期(qi)(qi)(qi)不(bu)得(de)超過(guo)(guo)15日;勞(lao)動(dong)合(he)同(tong)(tong)(tong)期(qi)(qi)(qi)限(xian)在(zai)6個月以上(shang)1年(nian)以內(nei)的(de)(de)(de)(de)(de),試(shi)用(yong)(yong)期(qi)(qi)(qi)不(bu)得(de)超過(guo)(guo)30日;勞(lao)動(dong)合(he)同(tong)(tong)(tong)期(qi)(qi)(qi)限(xian)在(zai)1年(nian)以上(shang)2年(nian)以內(nei)的(de)(de)(de)(de)(de),試(shi)用(yong)(yong)期(qi)(qi)(qi)不(bu)得(de)超過(guo)(guo)60日;勞(lao)動(dong)合(he)同(tong)(tong)(tong)期(qi)(qi)(qi)限(xian)在(zai)2年(nian)以上(shang)的(de)(de)(de)(de)(de),試(shi)用(yong)(yong)期(qi)(qi)(qi)不(bu)得(de)超過(guo)(guo)6個月。   四、當(dang)(dang)事(shi)人(ren)(ren)的(de)(de)(de)(de)(de)目的(de)(de)(de)(de)(de)不(bu)同(tong)(tong)(tong)。在(zai)試(shi)用(yong)(yong)期(qi)(qi)(qi)間,主(zhu)要體現(xian)用(yong)(yong)人(ren)(ren)單位(wei)目的(de)(de)(de)(de)(de),即(ji)為(wei)了(le)得(de)到滿足需要的(de)(de)(de)(de)(de)人(ren)(ren)力(li)資源(yuan);在(zai)實習期(qi)(qi)(qi)間,對于(yu)實習學(xue)生(sheng)所(suo)在(zai)的(de)(de)(de)(de)(de)單位(wei)來講,學(xue)生(sheng)的(de)(de)(de)(de)(de)實習活動(dong),和勞(lao)動(dong)者(zhe)的(de)(de)(de)(de)(de)生(sheng)產經營活動(dong)有(you)(you)相(xiang)同(tong)(tong)(tong)或相(xiang)似之處(chu),但在(zai)目的(de)(de)(de)(de)(de)上(shang)有(you)(you)本質(zhi)的(de)(de)(de)(de)(de)不(bu)同(tong)(tong)(tong),學(xue)生(sheng)實習活動(dong)主(zhu)要體現(xian)的(de)(de)(de)(de)(de)是(shi)學(xue)校與(yu)學(xue)生(sheng)的(de)(de)(de)(de)(de)共(gong)同(tong)(tong)(tong)目的(de)(de)(de)(de)(de),為(wei)了(le)提高(gao)實習學(xue)生(sheng)的(de)(de)(de)(de)(de)自身素質(zhi)。
