單位辭退什么樣的職工需要支付經濟補償?

問(wen) 我(wo)有(you)(you)一個朋友前(qian)幾(ji)天被單位辭退了,他(ta)本人并沒有(you)(you)什么違(wei)規違(wei)紀行為,這樣的(de)情況(kuang)他(ta)的(de)單位應該付給經濟補(bu)償(chang)嗎?

《勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)法》第40條規定:在(zai)(zai)以(yi)下三(san)種情(qing)形下,用人(ren)單(dan)位向勞(lao)(lao)(lao)(lao)動(dong)者(zhe)提出(chu)解(jie)除勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)時,應支付經濟補償金: (1)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)患病或者(zhe)非因工(gong)(gong)負傷,在(zai)(zai)規定的(de)醫療期滿(man)后(hou)不(bu)能(neng)(neng)(neng)從事原工(gong)(gong)作(zuo),也不(bu)能(neng)(neng)(neng)從事由用人(ren)單(dan)位另行(xing)安排(pai)的(de)工(gong)(gong)作(zuo)的(de); (2)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)不(bu)能(neng)(neng)(neng)勝(sheng)任工(gong)(gong)作(zuo),經過培訓或者(zhe)調整工(gong)(gong)作(zuo)崗位,仍(reng)不(bu)能(neng)(neng)(neng)勝(sheng)任工(gong)(gong)作(zuo)的(de); (3)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)訂立時所依據的(de)客觀情(qing)況發(fa)生重(zhong)大變(bian)化,致使勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)無法履行(xing),經用人(ren)單(dan)位與勞(lao)(lao)(lao)(lao)動(dong)者(zhe)協(xie)商(shang),未(wei)能(neng)(neng)(neng)就變(bian)更(geng)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)內容達成(cheng)協(xie)議的(de)。
