單位辭退什么樣的職工需要支付經濟補償?

我有(you)一個朋友(you)前幾(ji)天被單位辭退了,他本人并沒有(you)什么違規(gui)違紀行為,這樣的情況他的單位應該(gai)付(fu)給經(jing)濟(ji)補償嗎?

《勞(lao)動(dong)合同(tong)(tong)(tong)法(fa)》第40條規定(ding):在(zai)以(yi)下三種情形下,用人單位(wei)向(xiang)勞(lao)動(dong)者(zhe)提出解除勞(lao)動(dong)合同(tong)(tong)(tong)時,應支付(fu)經濟補償金: (1)勞(lao)動(dong)者(zhe)患病或者(zhe)非因工(gong)負傷,在(zai)規定(ding)的醫療期滿后不能從事原工(gong)作(zuo),也不能從事由用人單位(wei)另行安(an)排的工(gong)作(zuo)的; (2)勞(lao)動(dong)者(zhe)不能勝任(ren)工(gong)作(zuo),經過培(pei)訓或者(zhe)調整工(gong)作(zuo)崗(gang)位(wei),仍(reng)不能勝任(ren)工(gong)作(zuo)的; (3)勞(lao)動(dong)合同(tong)(tong)(tong)訂立時所依據的客觀(guan)情況發(fa)生重大變(bian)化(hua),致使勞(lao)動(dong)合同(tong)(tong)(tong)無法(fa)履行,經用人單位(wei)與勞(lao)動(dong)者(zhe)協商,未能就(jiu)變(bian)更勞(lao)動(dong)合同(tong)(tong)(tong)內容達成協議的。
