單位辭退什么樣的職工需要支付經濟補償?
問(wen) 我有(you)一個朋友前幾天被單(dan)(dan)位辭退(tui)了,他(ta)本(ben)人并沒(mei)有(you)什么違規違紀(ji)行為(wei),這樣的(de)情(qing)況他(ta)的(de)單(dan)(dan)位應該付給經濟補償嗎?
答 《勞(lao)動(dong)(dong)合同法》第40條規(gui)定:在以(yi)下三(san)種情形下,用(yong)人(ren)(ren)單位(wei)向勞(lao)動(dong)(dong)者(zhe)提出(chu)解除勞(lao)動(dong)(dong)合同時,應支付經濟補償金: (1)勞(lao)動(dong)(dong)者(zhe)患病或者(zhe)非因(yin)工(gong)(gong)(gong)負傷(shang),在規(gui)定的(de)醫療(liao)期滿后不能(neng)從事原工(gong)(gong)(gong)作,也不能(neng)從事由(you)用(yong)人(ren)(ren)單位(wei)另行安排的(de)工(gong)(gong)(gong)作的(de); (2)勞(lao)動(dong)(dong)者(zhe)不能(neng)勝任工(gong)(gong)(gong)作,經過培訓或者(zhe)調整工(gong)(gong)(gong)作崗(gang)位(wei),仍(reng)不能(neng)勝任工(gong)(gong)(gong)作的(de); (3)勞(lao)動(dong)(dong)合同訂(ding)立(li)時所依據的(de)客觀情況發生重大變化,致使(shi)勞(lao)動(dong)(dong)合同無法履(lv)行,經用(yong)人(ren)(ren)單位(wei)與勞(lao)動(dong)(dong)者(zhe)協商(shang),未能(neng)就變更(geng)勞(lao)動(dong)(dong)合同內(nei)容(rong)達成協議的(de)。
