首先繼續工(gong)(gong)作,取得單位拖(tuo)欠工(gong)(gong)資的(de)證(zheng)據后(hou),等(deng)哪天想(xiang)跟單位清算工(gong)(gong)資的(de)時候(hou),勞(lao)動(dong)者(zhe)可以到(dao)當(dang)地勞(lao)動(dong)仲(zhong)裁起訴(su)。其次當(dang)取得單位無故降低職(zhi)工(gong)(gong)工(gong)(gong)資的(de)證(zheng)據后(hou),再(zai)依(yi)據《勞(lao)動(dong)合(he)(he)同(tong)法》第(di)三(san)十八條“用(yong)人單位未及(ji)時足額支付勞(lao)動(dong)報酬的(de),勞(lao)動(dong)者(zhe)可以解(jie)除(chu)(chu)勞(lao)動(dong)合(he)(he)同(tong)”的(de)規定(ding),本人提出解(jie)除(chu)(chu)合(he)(he)同(tong)。并(bing)依(yi)據《勞(lao)動(dong)合(he)(he)同(tong)法》第(di)四十六條第(di)一款規定(ding),由用(yong)人單位向勞(lao)動(dong)者(zhe)支付經(jing)濟補償(chang)。
