首先繼續工(gong)作,取得單(dan)(dan)位(wei)(wei)拖欠工(gong)資的證據(ju)后(hou),等哪天想跟單(dan)(dan)位(wei)(wei)清(qing)算工(gong)資的時候,勞(lao)動(dong)(dong)者(zhe)(zhe)可(ke)(ke)以到當(dang)地勞(lao)動(dong)(dong)仲裁(cai)起訴。其次當(dang)取得單(dan)(dan)位(wei)(wei)無(wu)故降低職工(gong)工(gong)資的證據(ju)后(hou),再(zai)依(yi)據(ju)《勞(lao)動(dong)(dong)合同法》第三十(shi)八條“用人單(dan)(dan)位(wei)(wei)未(wei)及(ji)時足額支付(fu)勞(lao)動(dong)(dong)報酬的,勞(lao)動(dong)(dong)者(zhe)(zhe)可(ke)(ke)以解(jie)除勞(lao)動(dong)(dong)合同”的規定(ding),本(ben)人提出解(jie)除合同。并(bing)依(yi)據(ju)《勞(lao)動(dong)(dong)合同法》第四十(shi)六條第一款規定(ding),由(you)用人單(dan)(dan)位(wei)(wei)向勞(lao)動(dong)(dong)者(zhe)(zhe)支付(fu)經濟補(bu)償。
