單位任意降薪勞動者該怎么辦?

降(jiang)薪(xin)也就是(shi)降(jiang)低(di)工(gong)資,針對單位任意降(jiang)低(di)職工(gong)工(gong)資的行(xing)為,作(zuo)為員工(gong)該怎么辦?

首先繼(ji)續(xu)工(gong)(gong)作(zuo),取得(de)單(dan)位拖欠工(gong)(gong)資(zi)的證據(ju)后,等哪天想跟單(dan)位清算工(gong)(gong)資(zi)的時候,勞動(dong)者可(ke)以(yi)到當(dang)地勞動(dong)仲裁起(qi)訴。其次(ci)當(dang)取得(de)單(dan)位無(wu)故降低(di)職工(gong)(gong)工(gong)(gong)資(zi)的證據(ju)后,再依據(ju)《勞動(dong)合(he)(he)同(tong)法》第(di)(di)三十八(ba)條(tiao)“用人單(dan)位未及(ji)時足額支(zhi)付勞動(dong)報酬的,勞動(dong)者可(ke)以(yi)解(jie)除勞動(dong)合(he)(he)同(tong)”的規(gui)定,本人提(ti)出(chu)解(jie)除合(he)(he)同(tong)。并依據(ju)《勞動(dong)合(he)(he)同(tong)法》第(di)(di)四十六條(tiao)第(di)(di)一款規(gui)定,由用人單(dan)位向勞動(dong)者支(zhi)付經(jing)濟(ji)補償。
