試用期工資可以隨意約定嗎?

我(wo)們(men)現(xian)在的單位以試用(yong)期為借(jie)口,不給我(wo)們(men)繳納社會保(bao)險(xian)金,還隨(sui)意壓低(di)試用(yong)期工資(zi)。這樣(yang)做(zuo)合法(fa)嗎?

這些做(zuo)法是違(wei)法的。《勞(lao)動合同(tong)法實施條例》第十(shi)五條規定,勞(lao)動者在(zai)試(shi)(shi)用期(qi)(qi)(qi)的工(gong)資(zi)(zi)不(bu)得低(di)(di)于(yu)本單(dan)位(wei)相同(tong)崗位(wei)最低(di)(di)檔工(gong)資(zi)(zi)的80%或者不(bu)得低(di)(di)于(yu)勞(lao)動合同(tong)約定工(gong)資(zi)(zi)的80%,并(bing)不(bu)得低(di)(di)于(yu)用人單(dan)位(wei)所(suo)在(zai)地的最低(di)(di)工(gong)資(zi)(zi)標準。試(shi)(shi)用期(qi)(qi)(qi)包含在(zai)勞(lao)動合同(tong)期(qi)(qi)(qi)限內(nei)。在(zai)勞(lao)動合同(tong)期(qi)(qi)(qi)限內(nei),單(dan)位(wei)為職工(gong)繳(jiao)納社(she)會(hui)保(bao)險是法定義務(wu)。因此單(dan)位(wei)不(bu)能以試(shi)(shi)用期(qi)(qi)(qi)為借(jie)口不(bu)繳(jiao)社(she)會(hui)保(bao)險金(jin)。
