首先勞(lao)動(dong)(dong)者(zhe)患病或者(zhe)非因工(gong)(gong)負(fu)傷,在(zai)規定的醫療期滿(man)后(hou)不(bu)能從事原(yuan)工(gong)(gong)作(zuo)(zuo),也(ye)不(bu)能從事由用人單位(wei)另行(xing)安排的工(gong)(gong)作(zuo)(zuo)的;其次勞(lao)動(dong)(dong)者(zhe)不(bu)能勝(sheng)任(ren)工(gong)(gong)作(zuo)(zuo),經過培訓或者(zhe)調整工(gong)(gong)作(zuo)(zuo)崗位(wei),仍不(bu)能勝(sheng)任(ren)工(gong)(gong)作(zuo)(zuo)的;最(zui)后(hou)勞(lao)動(dong)(dong)合同訂立時所依據的客觀(guan)情(qing)況發生重大變化,致使勞(lao)動(dong)(dong)合同無法履行(xing),經用人單位(wei)與勞(lao)動(dong)(dong)者(zhe)協(xie)商,未能就變更勞(lao)動(dong)(dong)合同內容達成協(xie)議的。
