答(da) 根據《勞(lao)動(dong)(dong)合同法(fa)》第(di)八(ba)十(shi)三(san)條規定(ding):“用(yong)(yong)(yong)人(ren)單位違反本法(fa)規定(ding)與勞(lao)動(dong)(dong)者(zhe)約定(ding)試用(yong)(yong)(yong)期(qi)(qi)的,由勞(lao)動(dong)(dong)行政部(bu)門責令改正;違法(fa)約定(ding)的試用(yong)(yong)(yong)期(qi)(qi)已經履(lv)行的,由用(yong)(yong)(yong)人(ren)單位以勞(lao)動(dong)(dong)者(zhe)試用(yong)(yong)(yong)期(qi)(qi)滿月工資為標準,按(an)已經履(lv)行的超過法(fa)定(ding)試用(yong)(yong)(yong)期(qi)(qi)的期(qi)(qi)間向勞(lao)動(dong)(dong)者(zhe)支付賠償金。”
