年假不休該怎樣算回工資?

答(da) 用人(ren)(ren)單(dan)位(wei)經職(zhi)(zhi)(zhi)工(gong)(gong)同意(yi)不安排(pai)休年(nian)假(jia)(jia)(jia)或者安排(pai)職(zhi)(zhi)(zhi)工(gong)(gong)休假(jia)(jia)(jia)時(shi)間(jian)少于(yu)應(ying)休年(nian)假(jia)(jia)(jia)時(shi)間(jian),應(ying)當(dang)在本年(nian)度內(nei)對職(zhi)(zhi)(zhi)工(gong)(gong)應(ying)休假(jia)(jia)(jia)時(shi)間(jian),按(an)日(ri)工(gong)(gong)資收入的(de)300%支付(fu)未休年(nian)假(jia)(jia)(jia)期(qi)間(jian)的(de)工(gong)(gong)資,其(qi)中包含用人(ren)(ren)單(dan)位(wei)支付(fu)職(zhi)(zhi)(zhi)工(gong)(gong)正(zheng)常(chang)工(gong)(gong)作(zuo)期(qi)間(jian)的(de)工(gong)(gong)資。用人(ren)(ren)單(dan)位(wei)安排(pai)職(zhi)(zhi)(zhi)工(gong)(gong)休假(jia)(jia)(jia),但(dan)是職(zhi)(zhi)(zhi)工(gong)(gong)因本人(ren)(ren)原因且(qie)書面提出不休假(jia)(jia)(jia)的(de),用人(ren)(ren)單(dan)位(wei)可以(yi)只支付(fu)其(qi)正(zheng)常(chang)工(gong)(gong)作(zuo)期(qi)間(jian)的(de)工(gong)(gong)資。
