二次入職是否還能設定試用期?

近期我(wo)們招聘了一(yi)個因生寶寶離開公司的員工,請問二次入職是否還能設定試用期?

勞動合同(tong)法已經規定(ding)很清楚,同(tong)一用(yong)人單位對(dui)同(tong)一個勞動者(zhe)只(zhi)能(neng)約定(ding)一次試用(yong)期,并沒(mei)有加(jia)前置條(tiao)件,也就(jiu)(jiu)是(shi)不管是(shi)續(xu)簽、還是(shi)離職(zhi)后又(you)入(ru)職(zhi)重新(xin)簽,只(zhi)要是(shi)同(tong)一個人,同(tong)一用(yong)人單位在(zai)法律角(jiao)度上(shang)就(jiu)(jiu)不能(neng)約定(ding)“第(di)二次”
