不服從加班是否可以隨意解除勞動合同?

加班在(zai)職(zhi)場(chang)中很普遍的情況,那么(me)若職(zhi)工不服從(cong)加班,那么(me)企業是否(fou)可以隨意解(jie)除(chu)勞動合同(tong)?

《勞(lao)(lao)動(dong)法》第41條(tiao)(tiao)規定(ding):“用人單(dan)位由于生產經(jing)營(ying)需要,經(jing)與工(gong)會和(he)勞(lao)(lao)動(dong)者協商一致(zhi)后可延(yan)長工(gong)作時(shi)間(jian),一般每(mei)日(ri)不(bu)得超(chao)過(guo)1小時(shi),因(yin)特(te)殊原因(yin)需要延(yan)長工(gong)作時(shi)間(jian)的,在(zai)保障(zhang)勞(lao)(lao)動(dong)者身體健(jian)康的條(tiao)(tiao)件下延(yan)長工(gong)作時(shi)間(jian)每(mei)日(ri)不(bu)得超(chao)過(guo)3小時(shi),但是每(mei)月不(bu)得超(chao)過(guo)36小時(shi)。”《勞(lao)(lao)動(dong)合同法》第31條(tiao)(tiao)規定(ding):“用人單(dan)位應當嚴格執行勞(lao)(lao)動(dong)定(ding)額標準,不(bu)得強迫或(huo)者變相(xiang)強迫勞(lao)(lao)動(dong)者加班。”
