不服從加班是否可以隨意解除勞動合同?
問 加班(ban)在(zai)職(zhi)場(chang)中(zhong)很(hen)普遍(bian)的情況,那么若職(zhi)工不服從(cong)加班(ban),那么企業是否可以隨意(yi)解除(chu)勞動合同?
答 《勞(lao)(lao)動(dong)法(fa)》第41條(tiao)(tiao)規(gui)定(ding):“用人單位由于(yu)生(sheng)產經營需(xu)要,經與工(gong)(gong)會和勞(lao)(lao)動(dong)者(zhe)(zhe)協商一(yi)致后可延長(chang)工(gong)(gong)作(zuo)時(shi)(shi)間,一(yi)般每日(ri)不得超(chao)過(guo)1小時(shi)(shi),因特(te)殊原(yuan)因需(xu)要延長(chang)工(gong)(gong)作(zuo)時(shi)(shi)間的,在保障勞(lao)(lao)動(dong)者(zhe)(zhe)身體健康的條(tiao)(tiao)件下延長(chang)工(gong)(gong)作(zuo)時(shi)(shi)間每日(ri)不得超(chao)過(guo)3小時(shi)(shi),但是每月不得超(chao)過(guo)36小時(shi)(shi)。”《勞(lao)(lao)動(dong)合同法(fa)》第31條(tiao)(tiao)規(gui)定(ding):“用人單位應當嚴格執(zhi)行(xing)勞(lao)(lao)動(dong)定(ding)額標準(zhun),不得強(qiang)迫或者(zhe)(zhe)變相強(qiang)迫勞(lao)(lao)動(dong)者(zhe)(zhe)加班。”
