答 從權利和(he)義(yi)務(wu)一(yi)致的(de)規則(ze)來(lai)看，畢業實(shi)(shi)習(xi)(xi)(xi)(xi)期間(jian)(jian)實(shi)(shi)習(xi)(xi)(xi)(xi)生(sheng)與實(shi)(shi)習(xi)(xi)(xi)(xi)單(dan)(dan)(dan)位(wei)(wei)之間(jian)(jian)沒有建立勞(lao)(lao)動(dong)(dong)合(he)(he)同關系。尚未(wei)畢業離校(xiao)(xiao)的(de)大學生(sheng)其人(ren)身屬性(xing)為所在院校(xiao)(xiao)的(de)學生(sheng)而(er)不(bu)是(shi)實(shi)(shi)習(xi)(xi)(xi)(xi)單(dan)(dan)(dan)位(wei)(wei)的(de)員工(gong)不(bu)可能像用人(ren)單(dan)(dan)(dan)位(wei)(wei)的(de)勞(lao)(lao)動(dong)(dong)者一(yi)樣全面遵守實(shi)(shi)習(xi)(xi)(xi)(xi)單(dan)(dan)(dan)位(wei)(wei)包括出勤(qin)、考(kao)勤(qin)、考(kao)核在內的(de)各項規章制(zhi)度也不(bu)可能承擔用人(ren)單(dan)(dan)(dan)位(wei)(wei)一(yi)個(ge)完整的(de)勞(lao)(lao)動(dong)(dong)過程。同時，實(shi)(shi)習(xi)(xi)(xi)(xi)單(dan)(dan)(dan)位(wei)(wei)也不(bu)可能象寸(cun)待個(ge)正(zheng)式員工(gong)那(nei)樣給實(shi)(shi)習(xi)(xi)(xi)(xi)學生(sheng)安排(pai)完整的(de)工(gong)作任務(wu)。實(shi)(shi)習(xi)(xi)(xi)(xi)學生(sheng)不(bu)具有勞(lao)(lao)動(dong)(dong)法意義(yi)上的(de)勞(lao)(lao)動(dong)(dong)權利和(he)勞(lao)(lao)動(dong)(dong)義(yi)務(wu)，畢業實(shi)(shi)習(xi)(xi)(xi)(xi)期間(jian)(jian)實(shi)(shi)習(xi)(xi)(xi)(xi)生(sheng)與實(shi)(shi)習(xi)(xi)(xi)(xi)單(dan)(dan)(dan)位(wei)(wei)之間(jian)(jian)只能是(shi)勞(lao)(lao)務(wu)合(he)(he)同關系，而(er)不(bu)是(shi)勞(lao)(lao)動(dong)(dong)合(he)(he)同關系。
