答 從權利和(he)義(yi)務一致的規則來看，畢(bi)業實(shi)習(xi)(xi)(xi)(xi)期間(jian)實(shi)習(xi)(xi)(xi)(xi)生(sheng)與實(shi)習(xi)(xi)(xi)(xi)單(dan)位(wei)(wei)(wei)(wei)之間(jian)沒有建(jian)立勞(lao)(lao)動(dong)(dong)合(he)同關(guan)系(xi)。尚未畢(bi)業離校的大(da)學生(sheng)其人(ren)身屬性為所在院校的學生(sheng)而不是實(shi)習(xi)(xi)(xi)(xi)單(dan)位(wei)(wei)(wei)(wei)的員工不可能(neng)像用(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)的勞(lao)(lao)動(dong)(dong)者一樣全面遵(zun)守實(shi)習(xi)(xi)(xi)(xi)單(dan)位(wei)(wei)(wei)(wei)包(bao)括出勤(qin)、考(kao)勤(qin)、考(kao)核在內的各項規章制度也不可能(neng)承擔用(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)一個(ge)(ge)完(wan)整的勞(lao)(lao)動(dong)(dong)過(guo)程。同時(shi)，實(shi)習(xi)(xi)(xi)(xi)單(dan)位(wei)(wei)(wei)(wei)也不可能(neng)象(xiang)寸待個(ge)(ge)正式員工那樣給實(shi)習(xi)(xi)(xi)(xi)學生(sheng)安排完(wan)整的工作任(ren)務。實(shi)習(xi)(xi)(xi)(xi)學生(sheng)不具有勞(lao)(lao)動(dong)(dong)法意義(yi)上的勞(lao)(lao)動(dong)(dong)權利和(he)勞(lao)(lao)動(dong)(dong)義(yi)務，畢(bi)業實(shi)習(xi)(xi)(xi)(xi)期間(jian)實(shi)習(xi)(xi)(xi)(xi)生(sheng)與實(shi)習(xi)(xi)(xi)(xi)單(dan)位(wei)(wei)(wei)(wei)之間(jian)只能(neng)是勞(lao)(lao)務合(he)同關(guan)系(xi)，而不是勞(lao)(lao)動(dong)(dong)合(he)同關(guan)系(xi)。
