離職需要得到單位批準嗎?

問 在許多單位的離職流程中,都有勞動者離職須經領導批(pi)準的規定,請問這樣是否合理?
答(da) 在勞(lao)(lao)動(dong)(dong)者沒有簽(qian)訂服(fu)務期協(xie)議和競業限制協(xie)議的情(qing)況下,勞(lao)(lao)動(dong)(dong)者單(dan)方面解(jie)(jie)除勞(lao)(lao)動(dong)(dong)合(he)同(tong)只需要履行提前(qian)通知(zhi)(zhi)的義務即可,《勞(lao)(lao)動(dong)(dong)合(he)同(tong)法》第三十七條規(gui)定:“勞(lao)(lao)動(dong)(dong)者提前(qian)三十日以書(shu)面形式通知(zhi)(zhi)用人單(dan)位(wei),可以解(jie)(jie)除勞(lao)(lao)動(dong)(dong)合(he)同(tong)。”也就是(shi)說(shuo),勞(lao)(lao)動(dong)(dong)者提前(qian)離職,無須得到用人單(dan)位(wei)批準。
