公司沒招到人就不能辭職么?

最近我要辭職(zhi),公司說(shuo)還(huan)沒有招到頂替我的人,不讓我辭職(zhi)怎么(me)辦啊?

《勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)法》第(di)37條規(gui)(gui)定:“勞(lao)(lao)動(dong)(dong)(dong)者提(ti)(ti)前(qian)(qian)30日以(yi)書面(mian)形(xing)式通(tong)(tong)知(zhi)用人單位(wei),可(ke)(ke)以(yi)解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。勞(lao)(lao)動(dong)(dong)(dong)者在試用期內提(ti)(ti)前(qian)(qian)3日通(tong)(tong)知(zhi)用人單位(wei),可(ke)(ke)以(yi)解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。”由此可(ke)(ke)見(jian),勞(lao)(lao)動(dong)(dong)(dong)者可(ke)(ke)以(yi)根據(ju)自身情況或者個人發(fa)展需要等(deng)提(ti)(ti)出辭職,只要按法律規(gui)(gui)定的(de)(de)條件、程序,提(ti)(ti)前(qian)(qian)30日以(yi)書面(mian)形(xing)式通(tong)(tong)知(zhi)用人單位(wei),即可(ke)(ke)解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。30日后,勞(lao)(lao)動(dong)(dong)(dong)者可(ke)(ke)以(yi)向用人單位(wei)提(ti)(ti)出辦理解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)手續(xu),用人單位(wei)應予以(yi)辦理,并依法支(zhi)付相應的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)報酬。顯然,該(gai)公(gong)司以(yi)找(zhao)不到人代替工作崗位(wei)為由不準勞(lao)(lao)動(dong)(dong)(dong)者辭職的(de)(de)做法是(shi)違(wei)法的(de)(de)。
