答 《中華人(ren)(ren)民共和國勞(lao)(lao)(lao)動(dong)(dong)法》第三十二(er)條(tiao)規定了勞(lao)(lao)(lao)動(dong)(dong)者(zhe)可(ke)以隨(sui)時向(xiang)用(yong)(yong)人(ren)(ren)單(dan)位提出解除合(he)(he)同(tong)而不(bu)用(yong)(yong)提前三十天的三種情形,其(qi)中第三款就規定了:用(yong)(yong)人(ren)(ren)單(dan)位未(wei)按(an)照(zhao)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)約定支(zhi)付(fu)勞(lao)(lao)(lao)動(dong)(dong)報酬或者(zhe)提供勞(lao)(lao)(lao)動(dong)(dong)條(tiao)件(jian)的。該勞(lao)(lao)(lao)動(dong)(dong)者(zhe)的用(yong)(yong)人(ren)(ren)單(dan)位連(lian)續幾(ji)月(yue)都拖欠工(gong)資不(bu)發,明顯符(fu)合(he)(he)“用(yong)(yong)人(ren)(ren)單(dan)位未(wei)按(an)照(zhao)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)約定支(zhi)付(fu)勞(lao)(lao)(lao)動(dong)(dong)報酬”這一(yi)條(tiao)款,因此可(ke)以成為其(qi)立(li)即要(yao)求解除合(he)(he)同(tong)而不(bu)要(yao)再等30天的理由。
