答 應(ying)(ying)(ying)當(dang)(dang)訂(ding)立(li)勞(lao)(lao)(lao)動(dong)(dong)合同而(er)未訂(ding)立(li)的,勞(lao)(lao)(lao)動(dong)(dong)者(zhe)可以隨時終(zhong)止(zhi)勞(lao)(lao)(lao)動(dong)(dong)關系。應(ying)(ying)(ying)當(dang)(dang)訂(ding)立(li)勞(lao)(lao)(lao)動(dong)(dong)合同而(er)未訂(ding)立(li)的,用(yong)人單位提(ti)出終(zhong)止(zhi)勞(lao)(lao)(lao)動(dong)(dong)關系,應(ying)(ying)(ying)當(dang)(dang)提(ti)前三(san)十日(ri)通知勞(lao)(lao)(lao)動(dong)(dong)者(zhe),但勞(lao)(lao)(lao)動(dong)(dong)者(zhe)具有第三(san)十九(jiu)條規定情(qing)形(xing)之一的,勞(lao)(lao)(lao)動(dong)(dong)關系應(ying)(ying)(ying)當(dang)(dang)順延至該情(qing)形(xing)消(xiao)失。
