如果企業(ye)(ye)更(geng)(geng)換工作地點,尤(you)其是(shi)這樣跨省(sheng)市的(de)更(geng)(geng)換,單(dan)位應(ying)該(gai)盡(jin)量向員工提供上下(xia)班條(tiao)(tiao)(tiao)件(jian)。如果實在有(you)困難,《中(zhong)華人(ren)民(min)共和國(guo)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)法(fa)》第二十六條(tiao)(tiao)(tiao)規定:“有(you)下(xia)列情形(xing)之一(yi)的(de),用人(ren)單(dan)位可以解除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong),但是(shi)應(ying)當(dang)提前三十日以書面形(xing)式(shi)通(tong)知勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)本人(ren):……(三)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)訂立時所依據的(de)客(ke)觀(guan)情況(kuang)發生(sheng)重大變(bian)(bian)化,致(zhi)(zhi)使原勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)無(wu)法(fa)履行(xing),經(jing)當(dang)事人(ren)協(xie)商不(bu)能就變(bian)(bian)更(geng)(geng)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)達成協(xie)議的(de)。”對于(yu)該(gai)條(tiao)(tiao)(tiao)中(zhong)的(de)“客(ke)觀(guan)情況(kuang)發生(sheng)重大變(bian)(bian)化”, 勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)部《關于(yu)〈中(zhong)華人(ren)民(min)共和國(guo)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)法(fa)〉若干(gan)條(tiao)(tiao)(tiao)文的(de)說明》中(zhong)指出(chu)(chu):“本條(tiao)(tiao)(tiao)中(zhong)的(de)‘客(ke)觀(guan)情況(kuang)’指:發生(sheng)不(bu)可抗力(li)或出(chu)(chu)現致(zhi)(zhi)使勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)全部或部分(fen)條(tiao)(tiao)(tiao)款(kuan)無(wu)法(fa)履行(xing)的(de)其他情況(kuang),如企業(ye)(ye)遷(qian)移、被兼并、企業(ye)(ye)資產轉移等,并且排除(chu)(chu)本法(fa)第二十七條(tiao)(tiao)(tiao)(經(jing)濟(ji)性裁員——作者(zhe)注)所列的(de)客(ke)觀(guan)情況(kuang)。”因(yin)此,這種情況(kuang)應(ying)該(gai)有(you)一(yi)個(ge)協(xie)商的(de)過程,實在無(wu)法(fa)通(tong)過協(xie)商解決,公(gong)司應(ying)該(gai)解除(chu)(chu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong),并支付經(jing)濟(ji)補償金,不(bu)能逼迫員工自行(xing)辭職(zhi)。
