不給開離職證明怎么辦?
問 我在(zai)上家公司(si)離職一年了(le),現在(zai)要去(qu)開離職證明,但是公司(si)不給(gei)開怎么(me)辦啊?
答 《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同法》在制訂討(tao)論(lun)過(guo)程中(zhong),立法者(zhe)(zhe)(zhe)明(ming)確提出(chu)(chu)用(yong)人(ren)單(dan)位(wei)(wei)有(you)義務(wu)為(wei)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)開具離職(zhi)證明(ming)。所以2008年(nian)起(qi)實施的(de)《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同法》第五十條規定(ding):“用(yong)人(ren)單(dan)位(wei)(wei)應(ying)當在解除或者(zhe)(zhe)(zhe)終(zhong)止勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同時(shi)(shi)出(chu)(chu)具解除或者(zhe)(zhe)(zhe)終(zhong)止勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同的(de)證明(ming),并在十五日內為(wei)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)辦(ban)理檔案和社會保(bao)險關系轉移手續。”這樣(yang)的(de)安排,一方(fang)面是因為(wei)不少單(dan)位(wei)(wei)招錄時(shi)(shi)需(xu)要(yao)提供離職(zhi)證明(ming),以證實應(ying)聘者(zhe)(zhe)(zhe)的(de)工作經歷(li)。有(you)了出(chu)(chu)具離職(zhi)證明(ming)的(de)法定(ding)義務(wu),就可(ke)以避免勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)向(xiang)單(dan)位(wei)(wei)索取時(shi)(shi)無法可(ke)依的(de)囧境(jing)。另一方(fang)面這種(zhong)立法模式(shi),也更加鼓勵(li)新單(dan)位(wei)(wei)在招錄勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)時(shi)(shi)核實以往的(de)工作經歷(li),鼓勵(li)在用(yong)工雙(shuang)方(fang)之(zhi)間建立誠信(xin)。
