答 預告性辭(ci)退是(shi)指企業在辭(ci)退職(zhi)工(gong)(gong)時,按照法律(lv)的(de)規定(ding)提前30天通知職(zhi)工(gong)(gong)或(huo)支付代替(ti)通知金(jin)的(de)方式(shi)辭(ci)退職(zhi)工(gong)(gong)的(de)行為(wei)。主要(yao)有(you)以下情形:(1)勞動者(zhe)患病(bing)或(huo)非因(yin)工(gong)(gong)負(fu)傷,醫療期(qi)滿后,不(bu)(bu)能從(cong)事(shi)(shi)原工(gong)(gong)作(zuo)也(ye)不(bu)(bu)能從(cong)事(shi)(shi)用(yong)位(wei)另行安排(pai)的(de)工(gong)(gong)作(zuo);(2)勞動者(zhe)不(bu)(bu)能勝任工(gong)(gong)作(zuo),經過(guo)培訓或(huo)者(zhe)調整工(gong)(gong)作(zuo)崗位(wei),仍不(bu)(bu)能勝任工(gong)(gong)作(zuo)。(3)勞動合同(tong)訂立(li)時所依(yi)據的(de)客觀(guan)情況發生重大變化,致使勞動合同(tong)無法履行,經雙(shuang)方協商不(bu)(bu)能就變更勞動合同(tong)達成協議的(de)。
