答 《中華(hua)人(ren)(ren)民(min)共和國(guo)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同法》第三(san)(san)十(shi)七條規定:“勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)提(ti)(ti)前(qian)(qian)三(san)(san)十(shi)日(ri)以(yi)書面(mian)形式(shi)通(tong)知用(yong)人(ren)(ren)單(dan)位,可(ke)以(yi)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)合同。勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)在試用(yong)期內(nei)提(ti)(ti)前(qian)(qian)三(san)(san)日(ri)通(tong)知用(yong)人(ren)(ren)單(dan)位,可(ke)以(yi)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)合同。”這里有兩個要點(dian): 一是(shi)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)必須提(ti)(ti)前(qian)(qian)三(san)(san)十(shi)天(tian)通(tong)知。這里的(de)(de)三(san)(san)十(shi)天(tian),是(shi)指提(ti)(ti)出離職后,還要為(wei)用(yong)人(ren)(ren)單(dan)位工作三(san)(san)十(shi)天(tian),一來是(shi)讓(rang)用(yong)人(ren)(ren)單(dan)位有時(shi)間找到(dao)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)的(de)(de)繼任者(zhe)(zhe),二是(shi)讓(rang)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)完成手(shou)頭事務的(de)(de)后續工作和交接(jie)。 二是(shi)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)的(de)(de)通(tong)知必須以(yi)書面(mian)形式(shi)。
