答 《勞(lao)(lao)動(dong)(dong)法》第3條規(gui)定(ding)(ding),勞(lao)(lao)動(dong)(dong)者享(xiang)有取得(de)勞(lao)(lao)動(dong)(dong)報酬的權利。《工(gong)(gong)資支付(fu)(fu)暫行規(gui)定(ding)(ding)》第9條規(gui)定(ding)(ding),勞(lao)(lao)動(dong)(dong)關系雙方依(yi)法解(jie)除(chu)或終止勞(lao)(lao)動(dong)(dong)合(he)同(tong)時(shi),用人(ren)單位應在(zai)(zai)解(jie)除(chu)或終止勞(lao)(lao)動(dong)(dong)合(he)同(tong)時(shi)一次付(fu)(fu)清勞(lao)(lao)動(dong)(dong)者工(gong)(gong)資。勞(lao)(lao)動(dong)(dong)者提供了(le)勞(lao)(lao)動(dong)(dong),用人(ren)單位應當支付(fu)(fu)勞(lao)(lao)動(dong)(dong)報酬,解(jie)除(chu)勞(lao)(lao)動(dong)(dong)關系時(shi)雙方應當結清工(gong)(gong)資。工(gong)(gong)資作為正常勞(lao)(lao)動(dong)(dong)所得(de),在(zai)(zai)無(wu)法定(ding)(ding)情(qing)形下,用人(ren)單位無(wu)權扣除(chu)工(gong)(gong)資。
