答(da) 《勞(lao)(lao)動(dong)(dong)(dong)合(he)同法(fa)》第(di)(di)(di)三十(shi)九條 勞(lao)(lao)動(dong)(dong)(dong)者有(you)下列情形之(zhi)一(yi)的,用(yong)人(ren)單(dan)(dan)位(wei)可以(yi)解除勞(lao)(lao)動(dong)(dong)(dong)合(he)同: (一(yi))在試(shi)用(yong)期間(jian)被證明不符合(he)錄用(yong)條件的; (二)嚴(yan)重違(wei)反(fan)用(yong)人(ren)單(dan)(dan)位(wei)的規(gui)(gui)章制度的; (三)嚴(yan)重失職,營私(si)舞弊,給用(yong)人(ren)單(dan)(dan)位(wei)造成(cheng)重大(da)損害(hai)的; (四)勞(lao)(lao)動(dong)(dong)(dong)者同時與其他用(yong)人(ren)單(dan)(dan)位(wei)建立(li)勞(lao)(lao)動(dong)(dong)(dong)關系,對完成(cheng)本單(dan)(dan)位(wei)的工作任務造成(cheng)嚴(yan)重影(ying)響,或(huo)者經用(yong)人(ren)單(dan)(dan)位(wei)提出,拒不改正的; (五)因本法(fa)第(di)(di)(di)二十(shi)六(liu)條第(di)(di)(di)一(yi)款(kuan)第(di)(di)(di)一(yi)項規(gui)(gui)定的情形致使(shi)勞(lao)(lao)動(dong)(dong)(dong)合(he)同無(wu)效的; (六(liu))被依(yi)法(fa)追究刑(xing)事責任的。
