沒簽勞動合同可以隨時離職么?
問 我(wo)來公司上班一(yi)個多月了,一(yi)直沒有(you)跟(gen)我(wo)簽合同,請問(wen),我(wo)現(xian)在想離職(zhi)還需(xu)要(yao)提前一(yi)個月申請么(me)?
答 《勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同法》第10條規定(ding)(ding):建立(li)勞(lao)(lao)動(dong)(dong)(dong)關系,應(ying)當(dang)訂(ding)立(li)書面勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同。已建立(li)勞(lao)(lao)動(dong)(dong)(dong)關系,未同時訂(ding)立(li)書面勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同的,應(ying)當(dang)自用工之日起一(yi)個月(yue)內訂(ding)立(li)書面勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同。第30條規定(ding)(ding):用人單(dan)位(wei)應(ying)當(dang)按照勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同約定(ding)(ding)和國家規定(ding)(ding),向勞(lao)(lao)動(dong)(dong)(dong)者及時足額支付勞(lao)(lao)動(dong)(dong)(dong)報酬。由(you)此可見,該公司(si)不(bu)與勞(lao)(lao)動(dong)(dong)(dong)者簽訂(ding)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同、不(bu)給勞(lao)(lao)動(dong)(dong)(dong)者繳納社會保險費本身(shen)就是違法的,勞(lao)(lao)動(dong)(dong)(dong)者有權隨時辭職,無需提(ti)前一(yi)個月(yue)申(shen)請。
