沒簽勞動合同可以隨時離職么?
問 我(wo)來公(gong)司上班一個(ge)多月了,一直沒有跟我(wo)簽合同(tong),請問,我(wo)現在想離(li)職還(huan)需(xu)要提前一個(ge)月申請么?
答(da) 《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)法》第(di)10條規定:建(jian)立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)(guan)系,應(ying)當(dang)訂立書(shu)面(mian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。已建(jian)立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)(guan)系,未同(tong)時(shi)訂立書(shu)面(mian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)的,應(ying)當(dang)自(zi)用工之日起一個(ge)月內(nei)訂立書(shu)面(mian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。第(di)30條規定:用人(ren)單位(wei)應(ying)當(dang)按照勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)約定和(he)國家規定,向(xiang)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)及(ji)時(shi)足(zu)額支付(fu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)報(bao)酬。由此可見,該公司不與勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)簽訂勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)、不給勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)繳納社會保(bao)險(xian)費本身就是違法的,勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)有權隨時(shi)辭職(zhi),無(wu)需提前一個(ge)月申請。
