第(di)一,簽(qian)(qian)約主(zhu)體(ti)(ti)(ti)不(bu)(bu)同(tong)。集體(ti)(ti)(ti)合(he)同(tong)是(shi)由職(zhi)工(gong)(gong)(gong)代表與(yu)用(yong)人(ren)單(dan)位簽(qian)(qian)訂,而勞(lao)動(dong)(dong)合(he)同(tong)是(shi)由勞(lao)動(dong)(dong)者本人(ren)與(yu)用(yong)工(gong)(gong)(gong)單(dan)位簽(qian)(qian)訂。 第(di)二,簽(qian)(qian)訂程序不(bu)(bu)同(tong)。集體(ti)(ti)(ti)合(he)同(tong)需由職(zhi)工(gong)(gong)(gong)代表與(yu)用(yong)人(ren)單(dan)位先行(xing)協商合(he)同(tong)草案(an),經(jing)職(zhi)工(gong)(gong)(gong)代表大會或者全體(ti)(ti)(ti)職(zhi)工(gong)(gong)(gong)討論(lun)通(tong)過;而勞(lao)動(dong)(dong)合(he)同(tong)由職(zhi)工(gong)(gong)(gong)本人(ren)與(yu)用(yong)工(gong)(gong)(gong)單(dan)位直接(jie)簽(qian)(qian)訂。 第(di)三(san),生(sheng)(sheng)效(xiao)(xiao)條件不(bu)(bu)同(tong)。集體(ti)(ti)(ti)合(he)同(tong)簽(qian)(qian)訂后應當報送勞(lao)動(dong)(dong)行(xing)政(zheng)部(bu)門,勞(lao)動(dong)(dong)行(xing)政(zheng)部(bu)門自收到集體(ti)(ti)(ti)合(he)同(tong)之日(ri)起15日(ri)內(nei)未提出異議(yi)的,集體(ti)(ti)(ti)合(he)同(tong)即行(xing)生(sheng)(sheng)效(xiao)(xiao);而勞(lao)動(dong)(dong)合(he)同(tong)依法訂立即具(ju)有法律約束(shu)力。 第(di)四,效(xiao)(xiao)力所調整的主(zhu)體(ti)(ti)(ti)范圍不(bu)(bu)同(tong)。集體(ti)(ti)(ti)合(he)同(tong)生(sheng)(sheng)效(xiao)(xiao)后,對用(yong)工(gong)(gong)(gong)單(dan)位和(he)單(dan)位全體(ti)(ti)(ti)職(zhi)工(gong)(gong)(gong)具(ju)有約束(shu)力;而勞(lao)動(dong)(dong)合(he)同(tong)生(sheng)(sheng)效(xiao)(xiao)后僅適用(yong)于(yu)職(zhi)工(gong)(gong)(gong)本人(ren)和(he)用(yong)工(gong)(gong)(gong)單(dan)位。
