集體合同與勞動合同有什么不同?

答 第一(yi),簽(qian)(qian)(qian)約主體不(bu)同(tong)。集體合(he)同(tong)是由(you)(you)職工(gong)代表(biao)(biao)與(yu)(yu)用(yong)(yong)(yong)人單(dan)(dan)(dan)位(wei)(wei)(wei)簽(qian)(qian)(qian)訂(ding)(ding),而勞動(dong)(dong)合(he)同(tong)是由(you)(you)勞動(dong)(dong)者本人與(yu)(yu)用(yong)(yong)(yong)工(gong)單(dan)(dan)(dan)位(wei)(wei)(wei)簽(qian)(qian)(qian)訂(ding)(ding)。 第二,簽(qian)(qian)(qian)訂(ding)(ding)程序不(bu)同(tong)。集體合(he)同(tong)需由(you)(you)職工(gong)代表(biao)(biao)與(yu)(yu)用(yong)(yong)(yong)人單(dan)(dan)(dan)位(wei)(wei)(wei)先行(xing)協商合(he)同(tong)草案,經(jing)職工(gong)代表(biao)(biao)大會或者全體職工(gong)討論(lun)通過(guo);而勞動(dong)(dong)合(he)同(tong)由(you)(you)職工(gong)本人與(yu)(yu)用(yong)(yong)(yong)工(gong)單(dan)(dan)(dan)位(wei)(wei)(wei)直接簽(qian)(qian)(qian)訂(ding)(ding)。 第三,生(sheng)(sheng)效條(tiao)件(jian)不(bu)同(tong)。集體合(he)同(tong)簽(qian)(qian)(qian)訂(ding)(ding)后(hou)應(ying)當報送勞動(dong)(dong)行(xing)政部門(men)(men),勞動(dong)(dong)行(xing)政部門(men)(men)自收到(dao)集體合(he)同(tong)之日起(qi)15日內(nei)未提出異議的,集體合(he)同(tong)即行(xing)生(sheng)(sheng)效;而勞動(dong)(dong)合(he)同(tong)依法(fa)訂(ding)(ding)立(li)即具有(you)法(fa)律約束力。 第四,效力所(suo)調整的主體范圍不(bu)同(tong)。集體合(he)同(tong)生(sheng)(sheng)效后(hou),對用(yong)(yong)(yong)工(gong)單(dan)(dan)(dan)位(wei)(wei)(wei)和單(dan)(dan)(dan)位(wei)(wei)(wei)全體職工(gong)具有(you)約束力;而勞動(dong)(dong)合(he)同(tong)生(sheng)(sheng)效后(hou)僅(jin)適用(yong)(yong)(yong)于職工(gong)本人和用(yong)(yong)(yong)工(gong)單(dan)(dan)(dan)位(wei)(wei)(wei)。
