無固定期限勞動合同是不是“終身”制的?
問 我是(shi)一名技術工人(ren),在(zai)目前這家公司工作(zuo)十(shi)年了,公司明年就要和(he)我簽(qian)訂(ding)無(wu)固定期(qi)限(xian)勞動合同了,無(wu)固定期(qi)限(xian)勞動合同是(shi)不是(shi)“終身”制的?
答 訂(ding)立(li)無固(gu)定(ding)(ding)(ding)期(qi)限(xian)勞(lao)(lao)動合(he)(he)(he)同(tong)(tong)的簽訂(ding)條件是: (一)勞(lao)(lao)動者(zhe)已在(zai)該用人單位連(lian)續(xu)(xu)工作(zuo)滿(man)十年(nian)的; (二)用人單位初次(ci)實(shi)行勞(lao)(lao)動合(he)(he)(he)同(tong)(tong)制度(du)或者(zhe)國(guo)有(you)(you)企業改制重新訂(ding)立(li)勞(lao)(lao)動合(he)(he)(he)同(tong)(tong)時,勞(lao)(lao)動者(zhe)在(zai)該用人單位連(lian)續(xu)(xu)工作(zuo)滿(man)十年(nian)且距法(fa)定(ding)(ding)(ding)退休年(nian)齡不足十年(nian)的; (三(san))連(lian)續(xu)(xu)訂(ding)立(li)二次(ci)固(gu)定(ding)(ding)(ding)期(qi)限(xian)勞(lao)(lao)動合(he)(he)(he)同(tong)(tong)且勞(lao)(lao)動者(zhe)沒有(you)(you)本法(fa)第三(san)十九條規定(ding)(ding)(ding)的情(qing)(qing)形續(xu)(xu)訂(ding)勞(lao)(lao)動合(he)(he)(he)同(tong)(tong)的。 無固(gu)定(ding)(ding)(ding)期(qi)限(xian)勞(lao)(lao)動合(he)(he)(he)同(tong)(tong)并(bing)不是“終(zhong)身”制的,在(zai)履行合(he)(he)(he)同(tong)(tong)過程中,出現法(fa)定(ding)(ding)(ding)解除(chu)(chu)合(he)(he)(he)同(tong)(tong)情(qing)(qing)形,用人單位有(you)(you)權解除(chu)(chu)合(he)(he)(he)同(tong)(tong)。
