無固定期限勞動合同是不是“終身”制的?
問 我是一名技術工人(ren),在目(mu)前這家(jia)公司(si)(si)工作十(shi)年了(le),公司(si)(si)明年就要和(he)我簽(qian)訂無固(gu)定(ding)期(qi)限(xian)(xian)勞(lao)動合(he)同(tong)了(le),無固(gu)定(ding)期(qi)限(xian)(xian)勞(lao)動合(he)同(tong)是不是“終身”制的?
答 訂(ding)立無固(gu)定(ding)期(qi)限(xian)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)的(de)(de)簽訂(ding)條(tiao)件(jian)是(shi): (一)勞(lao)(lao)(lao)(lao)動(dong)者已在該用(yong)(yong)(yong)人(ren)(ren)單位(wei)(wei)連(lian)續(xu)工作滿十(shi)年(nian)的(de)(de); (二(er))用(yong)(yong)(yong)人(ren)(ren)單位(wei)(wei)初次實行勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)制(zhi)度或者國有(you)企業(ye)改制(zhi)重(zhong)新訂(ding)立勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)時(shi),勞(lao)(lao)(lao)(lao)動(dong)者在該用(yong)(yong)(yong)人(ren)(ren)單位(wei)(wei)連(lian)續(xu)工作滿十(shi)年(nian)且距(ju)法(fa)定(ding)退休年(nian)齡不足十(shi)年(nian)的(de)(de); (三)連(lian)續(xu)訂(ding)立二(er)次固(gu)定(ding)期(qi)限(xian)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)且勞(lao)(lao)(lao)(lao)動(dong)者沒有(you)本(ben)法(fa)第三十(shi)九(jiu)條(tiao)規定(ding)的(de)(de)情形(xing)續(xu)訂(ding)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)的(de)(de)。 無固(gu)定(ding)期(qi)限(xian)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)并不是(shi)“終身(shen)”制(zhi)的(de)(de),在履行合(he)同(tong)過(guo)程中(zhong),出現法(fa)定(ding)解除合(he)同(tong)情形(xing),用(yong)(yong)(yong)人(ren)(ren)單位(wei)(wei)有(you)權解除合(he)同(tong)。
