企業不提供合同規定的勞動條件和報酬怎么辦?

我上(shang)周找到(dao)的(de)這份工作,簽(qian)了合同(tong)(tong)才發現,公司(si)并沒有提供(gong)合同(tong)(tong)規定的(de)勞動條件和報酬,該怎么辦(ban)呢(ni)?

根據《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)法》第38條第1款(kuan)第1項的規定(ding),用人(ren)(ren)單位未(wei)能按照勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)約定(ding)提供(gong)勞(lao)(lao)(lao)動(dong)(dong)(dong)條件的,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)可以解除勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系。勞(lao)(lao)(lao)動(dong)(dong)(dong)對(dui)于員工來(lai)講既是義務也(ye)是權利,如果用人(ren)(ren)單位擅(shan)自變更勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)的內容(rong),就屬于違反(fan)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)約定(ding)的內容(rong),不提供(gong)約定(ding)的勞(lao)(lao)(lao)動(dong)(dong)(dong)條件,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)有權利解除與單位的勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系。
