沒有簽訂勞動合同該如何證明勞動關系呢?

我(wo)在濟南一家私人(ren)公(gong)司工(gong)作一個多月,辭職時要求支付(fu)工(gong)資,公(gong)司卻以(yi)未簽訂(ding)勞(lao)動合同為由否認我(wo)與公(gong)司的勞(lao)動合同,也不支付(fu)給我(wo)工(gong)資,我(wo)該(gai)怎么辦(ban)呢(ni)?

根據(ju)(ju)《勞(lao)(lao)動(dong)和(he)社會(hui)保(bao)障部(bu)關于確立勞(lao)(lao)動(dong)關系有(you)關事項(xiang)的通知》的規定(ding),用(yong)人(ren)單位(wei)未與勞(lao)(lao)動(dong)者(zhe)簽訂勞(lao)(lao)動(dong)合同,認定(ding)雙(shuang)方存(cun)在(zai)勞(lao)(lao)動(dong)關系時(shi)可參照下列憑(ping)證(zheng)(zheng):(一)工(gong)資(zi)支付憑(ping)證(zheng)(zheng)或記(ji)錄(lu)(職工(gong)工(gong)資(zi)發放花名(ming)冊)、繳納各(ge)項(xiang)社會(hui)保(bao)險(xian)費的記(ji)錄(lu);(二)用(yong)人(ren)單位(wei)向勞(lao)(lao)動(dong)者(zhe)發放的“工(gong)作(zuo)證(zheng)(zheng)”、“服務證(zheng)(zheng)”等能夠證(zheng)(zheng)明身份的證(zheng)(zheng)件;(三)勞(lao)(lao)動(dong)者(zhe)填(tian)寫的用(yong)人(ren)單位(wei)招(zhao)工(gong)招(zhao)聘“登(deng)記(ji)表”、“報名(ming)表”等招(zhao)用(yong)記(ji)錄(lu);(四(si))考(kao)勤(qin)記(ji)錄(lu);(五)其他(ta)勞(lao)(lao)動(dong)者(zhe)的證(zheng)(zheng)言等。你(ni)可以依(yi)據(ju)(ju)以上的證(zheng)(zheng)據(ju)(ju)到相關法律(lv)部(bu)門維護(hu)你(ni)的合法權益。
