問 我(wo)今天(tian)剛到公司(si)工(gong)作,公司(si)規(gui)定試用(yong)(yong)期(qi)(qi)時(shi)間為三個月(yue),但(dan)是卻沒有說明試用(yong)(yong)期(qi)(qi)工(gong)資,那么一般(ban)情況下,試用(yong)(yong)期(qi)(qi)工(gong)資是如何規(gui)定的呢(ni)?
答 試(shi)用期(qi)內(nei)職工(gong)(gong)的工(gong)(gong)資(zi)標準可以由(you)用人(ren)單位自行(xing)確定,但(dan)是(shi)卻不能(neng)低于最(zui)低工(gong)(gong)資(zi)標準。《關于貫徹執行(xing)〈勞(lao)(lao)動(dong)法〉若(ruo)干問題的意見》第57條規定:勞(lao)(lao)動(dong)者與用人(ren)單位形成或建立勞(lao)(lao)動(dong)關系(xi)后,試(shi)用、熟(shu)練、見習(xi)期(qi)間,在(zai)法定工(gong)(gong)作時間內(nei)提供了正常勞(lao)(lao)動(dong),所在(zai)單位應當(dang)支付其不低于最(zui)低工(gong)(gong)資(zi)標準的工(gong)(gong)資(zi)。
