在合同期內被辭退有什么補償嗎?
問 剛剛入職(zhi)時公(gong)司與我簽訂了兩年的合同,但是剛剛一年多,公(gong)司就要辭退我,公(gong)司應不應該付(fu)給我賠償(chang)呢?
答 在試用(yong)(yong)期中,除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)法第(di)(di)三(san)十九條(tiao)(tiao)和第(di)(di)四十條(tiao)(tiao)第(di)(di)一(yi)第(di)(di)二項規定的(de)(de)情形(xing)外,用(yong)(yong)人(ren)單(dan)(dan)(dan)位不得(de)解除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)。如果(guo)用(yong)(yong)人(ren)單(dan)(dan)(dan)位違反(fan)以上規定終(zhong)止勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong),按補償(chang)標準(zhun)的(de)(de)2倍支(zhi)付(fu)(fu)賠償(chang)金(jin)(jin)。如果(guo)是(shi)合(he)同(tong)期間被辭退(tui),經濟補償(chang)按勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者在本單(dan)(dan)(dan)位工(gong)作的(de)(de)年(nian)限,每(mei)滿一(yi)年(nian)支(zhi)付(fu)(fu)一(yi)個月(yue)工(gong)資的(de)(de)標準(zhun)向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者支(zhi)付(fu)(fu)。六個月(yue)以上不滿一(yi)年(nian)的(de)(de),按一(yi)年(nian)計算;不滿六個月(yue)的(de)(de),向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者支(zhi)付(fu)(fu)半個月(yue)工(gong)資的(de)(de)經濟補償(chang)。如果(guo)用(yong)(yong)人(ren)單(dan)(dan)(dan)位違法終(zhong)止勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong),按補償(chang)標準(zhun)的(de)(de)2倍支(zhi)付(fu)(fu)賠償(chang)金(jin)(jin)。
