企業違法解除合同應承擔什么責任?

答 用人(ren)單(dan)位(wei)違反《勞(lao)(lao)動(dong)(dong)合同法》規定(ding)解除(chu)或者終(zhong)止(zhi)勞(lao)(lao)動(dong)(dong)合同的(de)(de)(de)(de)(de), 應當依照(zhao)《勞(lao)(lao)動(dong)(dong)合同法》第47條規定(ding):經(jing)濟(ji)補償(chang)按勞(lao)(lao)動(dong)(dong)者在(zai)本(ben)單(dan)位(wei)工(gong)作的(de)(de)(de)(de)(de)年(nian)(nian)(nian)(nian)限,每(mei)滿一年(nian)(nian)(nian)(nian)支(zhi)(zhi)(zhi)(zhi)付(fu)一個(ge)(ge)月工(gong)資(zi)(zi)(zi)的(de)(de)(de)(de)(de)標準向(xiang)勞(lao)(lao)動(dong)(dong)者支(zhi)(zhi)(zhi)(zhi)付(fu)。六個(ge)(ge)月以上(shang)不(bu)滿一年(nian)(nian)(nian)(nian)的(de)(de)(de)(de)(de),按一年(nian)(nian)(nian)(nian)計算;不(bu)滿六個(ge)(ge)月的(de)(de)(de)(de)(de),向(xiang)勞(lao)(lao)動(dong)(dong)者支(zhi)(zhi)(zhi)(zhi)付(fu)半個(ge)(ge)月工(gong)資(zi)(zi)(zi)的(de)(de)(de)(de)(de)經(jing)濟(ji)補償(chang)。 勞(lao)(lao)動(dong)(dong)者月工(gong)資(zi)(zi)(zi)高(gao)(gao)于用人(ren)單(dan)位(wei)所在(zai)直轄市(shi)、設(she)區的(de)(de)(de)(de)(de)市(shi)級人(ren)民(min)政府公布的(de)(de)(de)(de)(de)本(ben)地區上(shang)年(nian)(nian)(nian)(nian)度職工(gong)月平均(jun)工(gong)資(zi)(zi)(zi)三(san)倍的(de)(de)(de)(de)(de),向(xiang)其支(zhi)(zhi)(zhi)(zhi)付(fu)經(jing)濟(ji)補償(chang)的(de)(de)(de)(de)(de)標準按職工(gong)月平均(jun)工(gong)資(zi)(zi)(zi)三(san)倍的(de)(de)(de)(de)(de)數額(e)支(zhi)(zhi)(zhi)(zhi)付(fu),向(xiang)其支(zhi)(zhi)(zhi)(zhi)付(fu)經(jing)濟(ji)補償(chang)的(de)(de)(de)(de)(de)年(nian)(nian)(nian)(nian)限最高(gao)(gao)不(bu)超過12年(nian)(nian)(nian)(nian)。
