企業違法解除合同應承擔什么責任?
問 我在濟南(nan)一(yi)家私企工作(zuo),上(shang)崗時間還(huan)不到兩年,公司經常開除員(yuan)工,企業(ye)違法解除合(he)同應承擔什么(me)責任?
答 用(yong)人(ren)單位違反《勞(lao)動(dong)合同(tong)法》規定解除或者(zhe)(zhe)終(zhong)止勞(lao)動(dong)合同(tong)的(de)(de)(de), 應(ying)當依照《勞(lao)動(dong)合同(tong)法》第47條規定:經(jing)濟(ji)補償按(an)勞(lao)動(dong)者(zhe)(zhe)在(zai)本單位工(gong)(gong)(gong)(gong)作的(de)(de)(de)年(nian)限(xian),每滿(man)(man)一(yi)年(nian)支付一(yi)個(ge)月(yue)工(gong)(gong)(gong)(gong)資的(de)(de)(de)標準向勞(lao)動(dong)者(zhe)(zhe)支付。六個(ge)月(yue)以上不滿(man)(man)一(yi)年(nian)的(de)(de)(de),按(an)一(yi)年(nian)計(ji)算(suan);不滿(man)(man)六個(ge)月(yue)的(de)(de)(de),向勞(lao)動(dong)者(zhe)(zhe)支付半(ban)個(ge)月(yue)工(gong)(gong)(gong)(gong)資的(de)(de)(de)經(jing)濟(ji)補償。 勞(lao)動(dong)者(zhe)(zhe)月(yue)工(gong)(gong)(gong)(gong)資高(gao)于用(yong)人(ren)單位所在(zai)直轄市(shi)、設區(qu)的(de)(de)(de)市(shi)級人(ren)民政府(fu)公布的(de)(de)(de)本地區(qu)上年(nian)度職工(gong)(gong)(gong)(gong)月(yue)平(ping)均(jun)工(gong)(gong)(gong)(gong)資三(san)(san)倍的(de)(de)(de),向其(qi)支付經(jing)濟(ji)補償的(de)(de)(de)標準按(an)職工(gong)(gong)(gong)(gong)月(yue)平(ping)均(jun)工(gong)(gong)(gong)(gong)資三(san)(san)倍的(de)(de)(de)數額支付,向其(qi)支付經(jing)濟(ji)補償的(de)(de)(de)年(nian)限(xian)最(zui)高(gao)不超(chao)過12年(nian)。
