試用期出現什么情況,企業可以解除合同?

答(da) (1)在(zai)試(shi)用(yong)(yong)期間被(bei)證(zheng)明(ming)不符合(he)(he)錄(lu)用(yong)(yong)條件的(de)(de); (2)嚴(yan)重違反用(yong)(yong)人(ren)單(dan)(dan)位(wei)的(de)(de)規(gui)章制度(du)的(de)(de); (3)嚴(yan)重失職,營私舞(wu)弊,給用(yong)(yong)人(ren)單(dan)(dan)位(wei)造成(cheng)重大損(sun)害的(de)(de); (4)勞(lao)(lao)動(dong)者(zhe)同時(shi)與(yu)(yu)其他(ta)用(yong)(yong)人(ren)單(dan)(dan)位(wei)建立勞(lao)(lao)動(dong)關系(xi),對完成(cheng)本(ben)單(dan)(dan)位(wei)的(de)(de)工(gong)(gong)作(zuo)任務造成(cheng)嚴(yan)重影響,或(huo)者(zhe)經用(yong)(yong)人(ren)單(dan)(dan)位(wei)提出,拒不改正的(de)(de); (5)因以欺詐、脅迫(po)的(de)(de)手段或(huo)者(zhe)乘人(ren)之(zhi)危,使(shi)對方在(zai)違背真實意思(si)的(de)(de)情(qing)(qing)況下訂(ding)立或(huo)者(zhe)變更勞(lao)(lao)動(dong)合(he)(he)同的(de)(de)情(qing)(qing)形(xing)致使(shi)勞(lao)(lao)動(dong)合(he)(he)同無效的(de)(de); (6)被(bei)依法追(zhui)究刑事責任的(de)(de); (7)勞(lao)(lao)動(dong)者(zhe)患病或(huo)者(zhe)非(fei)因工(gong)(gong)負(fu)傷,在(zai)規(gui)定的(de)(de)醫療(liao)期滿后(hou)不能(neng)從事原工(gong)(gong)作(zuo),也不能(neng)從事由用(yong)(yong)人(ren)單(dan)(dan)位(wei)另(ling)行安排的(de)(de)工(gong)(gong)作(zuo)的(de)(de); (8)勞(lao)(lao)動(dong)者(zhe)不能(neng)勝任工(gong)(gong)作(zuo),經過培訓(xun)或(huo)者(zhe)調整工(gong)(gong)作(zuo)崗位(wei),仍不能(neng)勝任工(gong)(gong)作(zuo)的(de)(de)。 此外,即(ji)使(shi)勞(lao)(lao)動(dong)者(zhe)符合(he)(he)上(shang)述情(qing)(qing)形(xing)之(zhi)一,用(yong)(yong)人(ren)單(dan)(dan)位(wei)需要在(zai)試(shi)用(yong)(yong)期與(yu)(yu)勞(lao)(lao)動(dong)者(zhe)解除勞(lao)(lao)動(dong)合(he)(he)同的(de)(de),應當(dang)向(xiang)勞(lao)(lao)動(dong)者(zhe)說明(ming)理由。
