企業在什么情況下辭退職工要支付經濟補償?

我現在(zai)正在(zai)濟(ji)南,前幾天公司通知我,要(yao)(yao)和我解除合同(tong),企業在(zai)什么情況下辭退(tui)職工要(yao)(yao)支付經濟(ji)補償?

《勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)法(fa)》第(di)40條規定:在以下(xia)三(san)種情形下(xia),用人單(dan)位(wei)向勞(lao)(lao)(lao)動(dong)(dong)者(zhe)提出(chu)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)時,應支付經(jing)濟補償金: (1)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)患(huan)病或者(zhe)非因(yin)工(gong)負傷,在規定的(de)(de)(de)醫療期滿后不能(neng)(neng)從(cong)事(shi)(shi)原(yuan)工(gong)作(zuo),也(ye)不能(neng)(neng)從(cong)事(shi)(shi)由(you)用人單(dan)位(wei)另行安排的(de)(de)(de)工(gong)作(zuo)的(de)(de)(de); (2)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)不能(neng)(neng)勝任(ren)工(gong)作(zuo),經(jing)過培訓或者(zhe)調(diao)整工(gong)作(zuo)崗位(wei),仍不能(neng)(neng)勝任(ren)工(gong)作(zuo)的(de)(de)(de); (3)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)訂立時所依據的(de)(de)(de)客觀情況發生重大變化,致使勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)無法(fa)履行,經(jing)用人單(dan)位(wei)與勞(lao)(lao)(lao)動(dong)(dong)者(zhe)協(xie)商,未能(neng)(neng)就變更勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)內容達成協(xie)議的(de)(de)(de)。
