企業在什么情況下辭退職工要支付經濟補償?
問 我現(xian)在正(zheng)在濟南,前幾天公司通(tong)知(zhi)我,要和(he)我解除合(he)同,企(qi)業在什(shen)么情況下辭退職工要支(zhi)付(fu)經濟補償?
答 《勞動(dong)(dong)(dong)(dong)合(he)(he)同(tong)法》第(di)40條規定:在以下(xia)三(san)種情形(xing)下(xia),用人單位向勞動(dong)(dong)(dong)(dong)者(zhe)提出解除勞動(dong)(dong)(dong)(dong)合(he)(he)同(tong)時,應支付(fu)經濟補(bu)償金: (1)勞動(dong)(dong)(dong)(dong)者(zhe)患(huan)病或者(zhe)非(fei)因(yin)工(gong)(gong)(gong)負傷,在規定的(de)(de)醫療期滿后不(bu)(bu)能(neng)(neng)從事(shi)原(yuan)工(gong)(gong)(gong)作(zuo),也不(bu)(bu)能(neng)(neng)從事(shi)由用人單位另行(xing)安排的(de)(de)工(gong)(gong)(gong)作(zuo)的(de)(de); (2)勞動(dong)(dong)(dong)(dong)者(zhe)不(bu)(bu)能(neng)(neng)勝任工(gong)(gong)(gong)作(zuo),經過培訓或者(zhe)調整(zheng)工(gong)(gong)(gong)作(zuo)崗位,仍不(bu)(bu)能(neng)(neng)勝任工(gong)(gong)(gong)作(zuo)的(de)(de); (3)勞動(dong)(dong)(dong)(dong)合(he)(he)同(tong)訂(ding)立時所依據的(de)(de)客觀情況(kuang)發(fa)生(sheng)重大變(bian)化,致使勞動(dong)(dong)(dong)(dong)合(he)(he)同(tong)無法履行(xing),經用人單位與勞動(dong)(dong)(dong)(dong)者(zhe)協(xie)商,未能(neng)(neng)就變(bian)更勞動(dong)(dong)(dong)(dong)合(he)(he)同(tong)內容達成(cheng)協(xie)議的(de)(de)。
