企業在什么情況下辭退職工要支付經濟補償?

我現在(zai)正在(zai)濟(ji)南,前幾(ji)天(tian)公司通知我,要和我解除(chu)合(he)同(tong),企業(ye)在(zai)什么情況(kuang)下辭退職工要支付經濟(ji)補(bu)償?

《勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)法》第40條規(gui)定(ding):在以(yi)下三種情形下,用人(ren)單位(wei)向勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)提(ti)出解除(chu)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)時,應支付經(jing)濟(ji)補償金: (1)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)患病或者(zhe)(zhe)非因工(gong)負傷,在規(gui)定(ding)的醫療期滿后不(bu)能(neng)從(cong)事原工(gong)作,也不(bu)能(neng)從(cong)事由用人(ren)單位(wei)另行安排的工(gong)作的; (2)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)不(bu)能(neng)勝任(ren)工(gong)作,經(jing)過培(pei)訓或者(zhe)(zhe)調整工(gong)作崗(gang)位(wei),仍不(bu)能(neng)勝任(ren)工(gong)作的; (3)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)訂立時所依據的客觀情況發生重大變化,致使勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)無法履行,經(jing)用人(ren)單位(wei)與勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)協商,未能(neng)就變更勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)內容達(da)成協議的。
