聘書就等于簽訂了勞動合同嗎?
問 前(qian)一段時間我面試了(le)(le)一家(jia)濟南的公(gong)司,前(qian)天收(shou)到了(le)(le)公(gong)司的聘書,還到公(gong)司簽了(le)(le)字蓋了(le)(le)章,這樣就相當于簽訂了(le)(le)勞動合同嗎?
答 聘書(shu)不具(ju)有(you)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)的效力(li)(li)。勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)法第十七條(tiao)規(gui)定(ding):“勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)應(ying)(ying)當具(ju)備以下條(tiao)款:(一)用人單位(wei)的名(ming)稱(cheng)、住所和(he)(he)法定(ding)代表人或(huo)者(zhe)主要(yao)負責人;(二)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)的姓(xing)名(ming)、住址和(he)(he)居民身(shen)份(fen)證或(huo)者(zhe)其他有(you)效身(shen)份(fen)證件號碼;(三)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)期(qi)限;(四)工作(zuo)(zuo)內容(rong)和(he)(he)工作(zuo)(zuo)地點;(五)工作(zuo)(zuo)時(shi)間和(he)(he)休(xiu)息休(xiu)假(jia);(六)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)報酬;(七)社會保險(xian);(八)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)保護、勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)條(tiao)件和(he)(he)職業危害防護;(九(jiu))法律、法規(gui)規(gui)定(ding)應(ying)(ying)當納入勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)的其他事項。”現實中,如果(guo)聘書(shu)的內容(rong)具(ju)備了(le)上述必備條(tiao)款,勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)也(ye)已經(jing)直接簽字認(ren)可,表明雙方對勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系的權(quan)利義務協商一致(zhi),聘書(shu)因轉化成了(le)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong),而具(ju)備勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)的效力(li)(li);如果(guo)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)未(wei)(wei)簽字認(ren)可,則意味著尚未(wei)(wei)具(ju)有(you)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)的效力(li)(li)。
