簽訂了《就業協議書》就等于簽訂了勞動合同嗎?
問(wen) 實習期滿后,單位跟(gen)我簽訂了(le)《就業(ye)協議(yi)(yi)書(shu)(shu)》,但(dan)是(shi)一直拒絕跟(gen)我簽訂勞動合同,并解釋說簽了(le)就業(ye)協議(yi)(yi)書(shu)(shu)就等于簽了(le)勞動合同,是(shi)這樣的嗎?
答(da) 勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)的簽訂(ding)是(shi)證明(ming)存在(zai)(zai)勞(lao)(lao)動(dong)(dong)關(guan)系最有利的證據,也是(shi)對用人(ren)單位和勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)之間權(quan)利義(yi)務的最好規范(fan)。首先,應要(yao)(yao)求用人(ren)單位及時(shi)和自己簽署書面的勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong),約定工(gong)資報酬、崗位、期限(xian)、工(gong)時(shi)制等(deng)主(zhu)要(yao)(yao)條(tiao)款;其次,要(yao)(yao)避免在(zai)(zai)空白勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)上簽字(zi),否則一(yi)旦(dan)用人(ren)單位改(gai)變約定的條(tiao)件(jian)并且將(jiang)不利條(tiao)件(jian)寫入(ru)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)中以(yi)后(hou),勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)就(jiu)處于不利地位了。另(ling)外,要(yao)(yao)注意(yi)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)有其最基本的構(gou)成(cheng)要(yao)(yao)件(jian),用人(ren)單位不能以(yi)簽訂(ding)了《就(jiu)業協(xie)議書》、入(ru)職登(deng)記表等(deng)為由拒絕簽訂(ding)書面勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)。
