如何處理個人勞動合同與集體勞動合同的關系?

簽訂了(le)集體(ti)合同(tong)(tong),就同(tong)(tong)時存在(zai)個人勞動(dong)合同(tong)(tong)與集體(ti)合同(tong)(tong)兩份(fen)合同(tong)(tong),那么,當兩份(fen)合同(tong)(tong)的內容不一致(zhi)時,該如何處(chu)理二者的關系(xi)呢?

集體合(he)(he)同(tong)對于(yu)勞(lao)(lao)(lao)動(dong)(dong)報酬、工(gong)作時間、加班休假、保(bao)險(xian)福利、職工(gong)培訓、勞(lao)(lao)(lao)動(dong)(dong)安全(quan)、女(nv)職工(gong)特殊保(bao)護等(deng)等(deng)的(de)規(gui)定(ding)(ding)形成了一個(ge)(ge)(ge)基(ji)本標準,勞(lao)(lao)(lao)動(dong)(dong)者個(ge)(ge)(ge)人(ren)與用(yong)人(ren)單位簽訂個(ge)(ge)(ge)人(ren)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)時,在(zai)勞(lao)(lao)(lao)動(dong)(dong)報酬和勞(lao)(lao)(lao)動(dong)(dong)條件等(deng)各方(fang)面的(de)規(gui)定(ding)(ding)不能(neng)低(di)于(yu)集體合(he)(he)同(tong)中的(de)基(ji)本標準,個(ge)(ge)(ge)人(ren)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)約定(ding)(ding)的(de)內容如果低(di)于(yu)這(zhe)個(ge)(ge)(ge)標準,則(ze)應按(an)集體合(he)(he)同(tong)的(de)規(gui)定(ding)(ding)執(zhi)行(xing);個(ge)(ge)(ge)人(ren)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)約定(ding)(ding)的(de)內容如果高(gao)于(yu)這(zhe)個(ge)(ge)(ge)標準,則(ze)按(an)照個(ge)(ge)(ge)人(ren)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)的(de)約定(ding)(ding)執(zhi)行(xing)。
