勞動合同中約定將社保費直接付給員工有效嗎?

我下(xia)周一(yi)就(jiu)要簽(qian)勞動(dong)合(he)同了,想問一(yi)下(xia)大家(jia)勞動(dong)合(he)同中(zhong)約定將社保費直接(jie)付給員工有效(xiao)嗎?

《勞(lao)(lao)(lao)動(dong)(dong)法(fa)(fa)》規定,“用人(ren)(ren)單位和(he)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)必須依(yi)法(fa)(fa)參(can)加(jia)社(she)(she)會保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian)”。可見,社(she)(she)會保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian)具有(you)強制(zhi)性,依(yi)法(fa)(fa)參(can)加(jia)社(she)(she)會保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian),繳(jiao)納保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian)費用,是(shi)用人(ren)(ren)單位和(he)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)的法(fa)(fa)定責任和(he)義(yi)務。只要(yao)用人(ren)(ren)單位和(he)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)依(yi)法(fa)(fa)確(que)立了勞(lao)(lao)(lao)動(dong)(dong)關系,用人(ren)(ren)單位就必須參(can)加(jia)社(she)(she)會保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian),按照社(she)(she)會保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian)的項目、保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian)費繳(jiao)納的方(fang)(fang)式和(he)標(biao)準(zhun)、保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian)待(dai)遇(yu)的內容和(he)標(biao)準(zhun)等,為員工辦理參(can)加(jia)社(she)(she)會保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian)的相關手續。由于參(can)加(jia)社(she)(she)會保(bao)(bao)(bao)險(xian)(xian)(xian)(xian)(xian)是(shi)法(fa)(fa)律規定的強制(zhi)性義(yi)務,因此,其(qi)不(bu)因雙方(fang)(fang)當(dang)事人(ren)(ren)的任何約(yue)定而(er)被排(pai)除。所以,勞(lao)(lao)(lao)動(dong)(dong)合同中約(yue)定將社(she)(she)保(bao)(bao)(bao)費直接付給(gei)員工是(shi)無效的。
