職工拒簽合同,單位終止勞動關系時還用付補償嗎?

問 我們(men)單位有職(zhi)工(gong)拒簽(qian)勞(lao)動(dong)合同(tong),請(qing)問如果單位終止勞(lao)動(dong)關系,還用(yong)付補償嗎?
答 根據《勞(lao)(lao)(lao)動(dong)(dong)合同法實施條(tiao)例(li)》第5條(tiao)規(gui)定,自用(yong)工之日(ri)起(qi)一個月(yue)內,經(jing)用(yong)人單(dan)位(wei)書(shu)面通(tong)知(zhi)后(hou),勞(lao)(lao)(lao)動(dong)(dong)者不與用(yong)人單(dan)位(wei)訂立書(shu)面勞(lao)(lao)(lao)動(dong)(dong)合同的,用(yong)人單(dan)位(wei)應(ying)當書(shu)面通(tong)知(zhi)勞(lao)(lao)(lao)動(dong)(dong)者終止勞(lao)(lao)(lao)動(dong)(dong)關系,無需向勞(lao)(lao)(lao)動(dong)(dong)者支付經(jing)濟補償,但是應(ying)當依法向勞(lao)(lao)(lao)動(dong)(dong)者支付其實際(ji)工作時間的勞(lao)(lao)(lao)動(dong)(dong)報(bao)酬。
