職工拒簽合同,單位終止勞動關系時還用付補償嗎?

問(wen) 我(wo)們單位(wei)有職(zhi)工拒簽勞動(dong)合(he)同,請(qing)問如果單位(wei)終止勞動(dong)關系,還用付補償嗎?

根據《勞(lao)動(dong)(dong)合同(tong)法實(shi)(shi)施條(tiao)例》第5條(tiao)規定,自用工(gong)之日起一個月(yue)內(nei),經(jing)用人單位(wei)書(shu)面通(tong)(tong)知(zhi)后,勞(lao)動(dong)(dong)者(zhe)不與用人單位(wei)訂立書(shu)面勞(lao)動(dong)(dong)合同(tong)的(de),用人單位(wei)應當書(shu)面通(tong)(tong)知(zhi)勞(lao)動(dong)(dong)者(zhe)終止勞(lao)動(dong)(dong)關系(xi),無需向勞(lao)動(dong)(dong)者(zhe)支(zhi)付經(jing)濟補償,但是應當依法向勞(lao)動(dong)(dong)者(zhe)支(zhi)付其實(shi)(shi)際工(gong)作時(shi)間的(de)勞(lao)動(dong)(dong)報酬。
