用人單位先試用后簽勞動合同合理嗎?

來工作一(yi)個星(xing)期了還(huan)沒簽(qian)勞動合(he)同,問上司,上司說先試用后簽(qian)勞動合(he)同,請(qing)問這樣合(he)理(li)嗎?

答(da) 不合理。“試(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)”是指(zhi)用(yong)(yong)(yong)(yong)人單位(wei)和勞(lao)(lao)動(dong)者為相互了解(jie)、選擇(ze)而約(yue)定的考察期(qi)(qi)。根據勞(lao)(lao)動(dong)法等相關法律、法規規定,用(yong)(yong)(yong)(yong)人單位(wei)可以與勞(lao)(lao)動(dong)者約(yue)定試(shi)用(yong)(yong)(yong)(yong)期(qi)(qi),但試(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)應包括在勞(lao)(lao)動(dong)合同(tong)期(qi)(qi)限內,用(yong)(yong)(yong)(yong)人單位(wei)不能(neng)先試(shi)用(yong)(yong)(yong)(yong)后簽(qian)訂勞(lao)(lao)動(dong)合同(tong)。
