兩家單位合并,勞動合同還能繼續履行嗎?

答 《勞(lao)動(dong)合(he)(he)同(tong)(tong)法(fa)》第34條規定(ding),如果用(yong)人(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)發生合(he)(he)并(bing)或者(zhe)分立(li)等情況,原勞(lao)動(dong)合(he)(he)同(tong)(tong)繼續(xu)有(you)效(xiao),勞(lao)動(dong)合(he)(he)同(tong)(tong)由承繼其權利和義務的(de)(de)用(yong)人(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)繼續(xu)履(lv)行。勞(lao)動(dong)合(he)(he)同(tong)(tong)簽訂后(hou),用(yong)人(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)的(de)(de)基(ji)本情況有(you)可能發生變化(hua),比如用(yong)人(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)的(de)(de)名稱、法(fa)定(ding)代表(biao)人(ren)、投資人(ren)發生變化(hua)或者(zhe)單(dan)(dan)(dan)(dan)位(wei)(wei)發生合(he)(he)并(bing)、分立(li),這些(xie)變化(hua)都不(bu)影響(xiang)勞(lao)動(dong)合(he)(he)同(tong)(tong)的(de)(de)履(lv)行。因此,兩家單(dan)(dan)(dan)(dan)位(wei)(wei)合(he)(he)并(bing),勞(lao)動(dong)合(he)(he)同(tong)(tong)還能繼續(xu)履(lv)行。
