兩家單位合并,勞動合同還能繼續履行嗎?
問 我(wo)們單位(wei)跟(gen)另一家(jia)單位(wei)合并(bing)了,名稱(cheng)(cheng)改為另一家(jia)的單位(wei)名稱(cheng)(cheng)了,請問(wen)我(wo)們的勞動合同(tong)還能繼(ji)續履行嗎?
答 《勞(lao)動合(he)(he)同法》第34條規定,如(ru)果用(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)發生(sheng)合(he)(he)并或者分(fen)立(li)等情況(kuang),原勞(lao)動合(he)(he)同繼續有(you)效,勞(lao)動合(he)(he)同由承繼其權利和義務(wu)的用(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)繼續履行。勞(lao)動合(he)(he)同簽訂(ding)后,用(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)的基本情況(kuang)有(you)可能發生(sheng)變(bian)化,比如(ru)用(yong)(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)的名(ming)稱、法定代表人(ren)、投資人(ren)發生(sheng)變(bian)化或者單(dan)(dan)(dan)位(wei)發生(sheng)合(he)(he)并、分(fen)立(li),這些(xie)變(bian)化都不影響勞(lao)動合(he)(he)同的履行。因此(ci),兩(liang)家單(dan)(dan)(dan)位(wei)合(he)(he)并,勞(lao)動合(he)(he)同還能繼續履行。
