就業協議書可以代替勞動合同嗎?
問 我畢(bi)業(ye)前跟用(yong)人單位簽了(le)就業(ye)協議,現在畢(bi)業(ye)了(le),正式上班了(le),我問什么時候(hou)簽勞(lao)(lao)動(dong)合同,單位領導說,已經(jing)簽了(le)就業(ye)協議書(shu)(shu)了(le)就不(bu)用(yong)簽勞(lao)(lao)動(dong)合同了(le),請(qing)問就業(ye)協議書(shu)(shu)可以(yi)代替勞(lao)(lao)動(dong)合同嗎?
答 “就業協議書(shu)(shu)”不能(neng)代替(ti)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong),單憑“就業協議書(shu)(shu)”,學生正式報到(dao)就業后(hou)的勞動(dong)(dong)(dong)權利(li)無法得到(dao)保障。《勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)法》第十條明確規定,“建立(li)勞動(dong)(dong)(dong)關(guan)系(xi),應當訂(ding)立(li)書(shu)(shu)面(mian)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)。已建立(li)勞動(dong)(dong)(dong)關(guan)系(xi),未同(tong)(tong)時(shi)訂(ding)立(li)書(shu)(shu)面(mian)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的,應當自用工之日(ri)起一個月內訂(ding)立(li)書(shu)(shu)面(mian)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)。”
