就業協議書可以代替勞動合同嗎?

我(wo)畢業(ye)前(qian)跟用(yong)人單(dan)位簽了就(jiu)(jiu)業(ye)協議(yi),現(xian)在畢業(ye)了,正式上班了,我(wo)問什(shen)么(me)時候簽勞(lao)動(dong)合同,單(dan)位領導說(shuo),已經簽了就(jiu)(jiu)業(ye)協議(yi)書了就(jiu)(jiu)不用(yong)簽勞(lao)動(dong)合同了,請問就(jiu)(jiu)業(ye)協議(yi)書可以(yi)代替勞(lao)動(dong)合同嗎?

答(da) “就業(ye)(ye)協(xie)議書”不能代替勞動(dong)(dong)合同(tong)(tong),單憑“就業(ye)(ye)協(xie)議書”,學生正(zheng)式報到就業(ye)(ye)后的(de)(de)勞動(dong)(dong)權(quan)利無法(fa)得到保障。《勞動(dong)(dong)合同(tong)(tong)法(fa)》第十條明確(que)規定(ding),“建(jian)立勞動(dong)(dong)關系,應(ying)當訂(ding)立書面(mian)勞動(dong)(dong)合同(tong)(tong)。已建(jian)立勞動(dong)(dong)關系,未同(tong)(tong)時訂(ding)立書面(mian)勞動(dong)(dong)合同(tong)(tong)的(de)(de),應(ying)當自用(yong)工之日起一個月內(nei)訂(ding)立書面(mian)勞動(dong)(dong)合同(tong)(tong)。”
