就業協議書可以代替勞動合同嗎?
問 我畢業(ye)前跟用人(ren)單位簽了就業(ye)協(xie)議,現在畢業(ye)了,正式上(shang)班了,我問什么時候簽勞動(dong)(dong)合(he)同,單位領(ling)導說,已經簽了就業(ye)協(xie)議書(shu)了就不用簽勞動(dong)(dong)合(he)同了,請(qing)問就業(ye)協(xie)議書(shu)可以代替(ti)勞動(dong)(dong)合(he)同嗎(ma)?
答 “就(jiu)業協議書”不(bu)能(neng)代替勞(lao)動(dong)合(he)同(tong)(tong),單憑(ping)“就(jiu)業協議書”,學生正式報到就(jiu)業后的勞(lao)動(dong)權利無法(fa)(fa)得到保障。《勞(lao)動(dong)合(he)同(tong)(tong)法(fa)(fa)》第十條明確規(gui)定,“建(jian)立(li)勞(lao)動(dong)關(guan)系,應(ying)當(dang)訂立(li)書面(mian)勞(lao)動(dong)合(he)同(tong)(tong)。已建(jian)立(li)勞(lao)動(dong)關(guan)系,未同(tong)(tong)時訂立(li)書面(mian)勞(lao)動(dong)合(he)同(tong)(tong)的,應(ying)當(dang)自用工之(zhi)日(ri)起一個月(yue)內(nei)訂立(li)書面(mian)勞(lao)動(dong)合(he)同(tong)(tong)。”
