一般勞動合同應該具備哪些條款?

答 根據《勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)法》第17條(tiao)規(gui)定(ding)(ding),勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)應當(dang)具備以(yi)下基(ji)本條(tiao)款: 1、用人單位的名稱(cheng)、住(zhu)(zhu)所和(he)法定(ding)(ding)代表(biao)人或者主要負責人; 2、勞(lao)動(dong)(dong)(dong)(dong)者的姓名、住(zhu)(zhu)址(zhi)和(he)居民身份證或者其他有效身份證件號碼; 3、勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)期限; 4、工作(zuo)(zuo)(zuo)內容和(he)工作(zuo)(zuo)(zuo)地點; 5、工作(zuo)(zuo)(zuo)時(shi)間(jian)和(he)休息(xi)休假(jia); 6、勞(lao)動(dong)(dong)(dong)(dong)報酬(chou); 7、社會保險; 8、勞(lao)動(dong)(dong)(dong)(dong)保護、勞(lao)動(dong)(dong)(dong)(dong)條(tiao)件和(he)職業危害防護; 9、法律、法規(gui)規(gui)定(ding)(ding)應當(dang)納入勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)的其他事項。
