企業和哪些員工解除合同要支付經濟補償?

答 《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)法》第40條規定(ding):在(zai)以下(xia)(xia)三(san)種情形下(xia)(xia),用人(ren)單位向勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者提出解除(chu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)時,應(ying)支(zhi)付(fu)經(jing)濟補償金(jin): (1)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者患病或(huo)者非(fei)因工(gong)負(fu)傷(shang),在(zai)規定(ding)的(de)醫(yi)療期滿(man)后不(bu)能(neng)從事原工(gong)作,也不(bu)能(neng)從事由用人(ren)單位另行(xing)安排(pai)的(de)工(gong)作的(de); (2)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者不(bu)能(neng)勝(sheng)任(ren)工(gong)作,經(jing)過(guo)培訓或(huo)者調整工(gong)作崗位,仍不(bu)能(neng)勝(sheng)任(ren)工(gong)作的(de); (3)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)訂立(li)時所依據(ju)的(de)客觀情況發生(sheng)重(zhong)大變化(hua),致(zhi)使勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)無法履行(xing),經(jing)用人(ren)單位與勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者協商,未能(neng)就變更(geng)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)內容達成協議的(de)。
