問(wen) 我是(shi)一名機械師(shi),在山東(dong)省一家私企工(gong)作(zuo),最近公司效益不好,經常有人被(bei)辭退,企業和哪(na)些員(yuan)工(gong)解(jie)除合同要支(zhi)付經濟(ji)補償?

《勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)法(fa)》第40條規定:在(zai)以下(xia)三種情形下(xia),用人(ren)單位向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)提出解除勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)時,應支付經(jing)濟補償金: (1)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)患病或(huo)者(zhe)(zhe)非因工(gong)負傷,在(zai)規定的醫療期滿后不能(neng)從事(shi)原工(gong)作,也(ye)不能(neng)從事(shi)由(you)用人(ren)單位另行安排的工(gong)作的; (2)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)不能(neng)勝任(ren)工(gong)作,經(jing)過培訓或(huo)者(zhe)(zhe)調整工(gong)作崗位,仍不能(neng)勝任(ren)工(gong)作的; (3)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)訂(ding)立(li)時所依據的客觀情況發生重大變(bian)化,致使勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)無法(fa)履行,經(jing)用人(ren)單位與勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)協(xie)商,未能(neng)就變(bian)更勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)內(nei)容達成(cheng)協(xie)議(yi)的。
