答 《勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)法(fa)》第40條(tiao)規(gui)(gui)定:在以下(xia)三種(zhong)情(qing)形下(xia),用(yong)人(ren)單(dan)位(wei)(wei)向勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)者(zhe)(zhe)提(ti)出(chu)解(jie)除勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)時,應支(zhi)付經(jing)濟補(bu)償金: (1)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)者(zhe)(zhe)患(huan)病或(huo)者(zhe)(zhe)非因工(gong)負傷,在規(gui)(gui)定的醫療期滿(man)后不能(neng)(neng)(neng)從(cong)事(shi)原工(gong)作(zuo)(zuo),也不能(neng)(neng)(neng)從(cong)事(shi)由用(yong)人(ren)單(dan)位(wei)(wei)另行安排的工(gong)作(zuo)(zuo)的; (2)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)者(zhe)(zhe)不能(neng)(neng)(neng)勝任工(gong)作(zuo)(zuo),經(jing)過培訓(xun)或(huo)者(zhe)(zhe)調整工(gong)作(zuo)(zuo)崗位(wei)(wei),仍(reng)不能(neng)(neng)(neng)勝任工(gong)作(zuo)(zuo)的; (3)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)訂立時所(suo)依據的客觀情(qing)況發生重大變化,致(zhi)使勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)無(wu)法(fa)履(lv)行,經(jing)用(yong)人(ren)單(dan)位(wei)(wei)與勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)者(zhe)(zhe)協(xie)商,未能(neng)(neng)(neng)就變更勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)內(nei)容達成協(xie)議的。
