答 根據《勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)法》第39條規(gui)定,勞(lao)(lao)(lao)動(dong)(dong)者(zhe)有(you)下(xia)列六種情形之一的,用(yong)(yong)(yong)人(ren)(ren)(ren)單位可以(yi)解(jie)(jie)除(chu)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong): (1)在試用(yong)(yong)(yong)期間被證明不(bu)符合錄用(yong)(yong)(yong)條件的。 (2)嚴重違反用(yong)(yong)(yong)人(ren)(ren)(ren)單位的規(gui)章制度的。 (3)嚴重失職,營私舞弊,給用(yong)(yong)(yong)人(ren)(ren)(ren)單位造(zao)成重大損害的。 (4)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)同(tong)(tong)時與其他用(yong)(yong)(yong)人(ren)(ren)(ren)單位建(jian)立(li)勞(lao)(lao)(lao)動(dong)(dong)關系,對完(wan)成本(ben)單位的工作任務(wu)造(zao)成嚴重影(ying)響,或者(zhe)經用(yong)(yong)(yong)人(ren)(ren)(ren)單位提出(chu),拒不(bu)改正的。 (5)以(yi)欺詐、脅(xie)迫的手(shou)段或者(zhe)乘(cheng)人(ren)(ren)(ren)之危,使(shi)對方在違背(bei)真實意思的情況下(xia)訂立(li)或者(zhe)變(bian)更勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong),致(zhi)使(shi)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)無效的。 (6)被依法追究刑事責任的。 如果試用(yong)(yong)(yong)期內出(chu)現上述的情況,公司有(you)權利解(jie)(jie)除(chu)合同(tong)(tong),并且還部給經濟補償。
