“終止”與“解除”勞動合是一樣的嗎?

答(da) 勞動(dong)(dong)合同(tong)(tong)(tong)(tong)的(de)(de)終(zhong)(zhong)止(zhi)(zhi)與勞動(dong)(dong)合同(tong)(tong)(tong)(tong)的(de)(de)解除(chu)是兩(liang)個完全不(bu)同(tong)(tong)(tong)(tong)的(de)(de)法(fa)(fa)(fa)律概念。 根據勞動(dong)(dong)部有(you)關規定,勞動(dong)(dong)合同(tong)(tong)(tong)(tong)的(de)(de)解除(chu)是指勞動(dong)(dong)合同(tong)(tong)(tong)(tong)訂(ding)立后(hou),尚未全部履行以前,由于某種(zhong)(zhong)原(yuan)因導致(zhi)勞動(dong)(dong)合同(tong)(tong)(tong)(tong)一方或(huo)雙方當(dang)事人提(ti)前消滅勞動(dong)(dong)關系(xi)的(de)(de)法(fa)(fa)(fa)律行為。勞動(dong)(dong)合同(tong)(tong)(tong)(tong)的(de)(de)解除(chu)分為法(fa)(fa)(fa)定解除(chu)和約定解除(chu)兩(liang)種(zhong)(zhong)。 而(er)勞動(dong)(dong)合同(tong)(tong)(tong)(tong)的(de)(de)終(zhong)(zhong)止(zhi)(zhi),是指勞動(dong)(dong)合同(tong)(tong)(tong)(tong)期限(xian)屆滿或(huo)者有(you)其(qi)他符合法(fa)(fa)(fa)律規定的(de)(de)情形出現導致(zhi)勞動(dong)(dong)合同(tong)(tong)(tong)(tong)關系(xi)消滅。按(an)照《勞動(dong)(dong)合同(tong)(tong)(tong)(tong)法(fa)(fa)(fa)》規定,勞動(dong)(dong)合同(tong)(tong)(tong)(tong)的(de)(de)終(zhong)(zhong)止(zhi)(zhi)只(zhi)有(you)法(fa)(fa)(fa)定情形的(de)(de)終(zhong)(zhong)止(zhi)(zhi),而(er)不(bu)能(neng)有(you)約定條件下的(de)(de)終(zhong)(zhong)止(zhi)(zhi),否(fou)則,即(ji)使約定了,也是無效的(de)(de)。
