答 根據《勞(lao)(lao)工合同(tong)法》第(di)十六(liu)條 勞(lao)(lao)動(dong)(dong)(dong)合同(tong)由用人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)與(yu)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)協商一(yi)致,并經用人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)與(yu)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)在(zai)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)文(wen)本上簽(qian)字或(huo)者(zhe)蓋章生效。勞(lao)(lao)動(dong)(dong)(dong)合同(tong)文(wen)本由用人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)和勞(lao)(lao)動(dong)(dong)(dong)者(zhe)各執一(yi)份。第(di)十七(qi)條 勞(lao)(lao)動(dong)(dong)(dong)合同(tong)應(ying)當(dang)(dang)具備以下條款(kuan): (一(yi))用人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)的名稱(cheng)、住(zhu)所和法定(ding)代表人(ren)(ren)(ren)(ren)或(huo)者(zhe)主要負責人(ren)(ren)(ren)(ren); (二(er))勞(lao)(lao)動(dong)(dong)(dong)者(zhe)的姓名、住(zhu)址和居民身份證(zheng)或(huo)者(zhe)其他有(you)效身份證(zheng)件(jian)號碼(ma); (三)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)期(qi)限; (四)工作內容(rong)和工作地(di)點; (五(wu))工作時(shi)間(jian)和休息休假; (六(liu))勞(lao)(lao)動(dong)(dong)(dong)報酬; (七(qi))社會保(bao)險; (八)勞(lao)(lao)動(dong)(dong)(dong)保(bao)護、勞(lao)(lao)動(dong)(dong)(dong)條件(jian)和職業危害防護; (九(jiu))法律、法規(gui)規(gui)定(ding)應(ying)當(dang)(dang)納入勞(lao)(lao)動(dong)(dong)(dong)合同(tong)的其他事項。 勞(lao)(lao)動(dong)(dong)(dong)合同(tong)除(chu)前(qian)款(kuan)規(gui)定(ding)的必備條款(kuan)外,用人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)與(yu)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)可(ke)以約定(ding)試用期(qi)、培訓、保(bao)守(shou)秘(mi)密、補充保(bao)險和福利待遇等其他事項。
