根據《勞(lao)工(gong)合同(tong)(tong)法(fa)(fa)》第十六條 勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)由(you)用(yong)人(ren)(ren)單(dan)位(wei)(wei)與勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)協(xie)商(shang)一(yi)致(zhi),并經用(yong)人(ren)(ren)單(dan)位(wei)(wei)與勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)在(zai)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)文本上簽(qian)字或(huo)者(zhe)(zhe)(zhe)蓋章生效。勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)文本由(you)用(yong)人(ren)(ren)單(dan)位(wei)(wei)和(he)(he)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)各執(zhi)一(yi)份(fen)。第十七條 勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)應當(dang)(dang)具備以下條款: (一(yi))用(yong)人(ren)(ren)單(dan)位(wei)(wei)的名(ming)稱、住所和(he)(he)法(fa)(fa)定(ding)代表人(ren)(ren)或(huo)者(zhe)(zhe)(zhe)主要(yao)負責人(ren)(ren); (二)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)的姓名(ming)、住址和(he)(he)居民身份(fen)證或(huo)者(zhe)(zhe)(zhe)其(qi)他(ta)有效身份(fen)證件(jian)號碼(ma); (三)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)期(qi)限; (四)工(gong)作(zuo)內(nei)容和(he)(he)工(gong)作(zuo)地點; (五)工(gong)作(zuo)時間和(he)(he)休(xiu)息休(xiu)假(jia); (六)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)報酬; (七)社會保險; (八)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)保護、勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)條件(jian)和(he)(he)職(zhi)業危害防護; (九)法(fa)(fa)律、法(fa)(fa)規規定(ding)應當(dang)(dang)納(na)入勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)的其(qi)他(ta)事項(xiang)。 勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)除(chu)前款規定(ding)的必備條款外,用(yong)人(ren)(ren)單(dan)位(wei)(wei)與勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)可以約定(ding)試用(yong)期(qi)、培訓(xun)、保守秘密(mi)、補充保險和(he)(he)福利待遇等其(qi)他(ta)事項(xiang)。
