答 根據《勞(lao)(lao)(lao)(lao)工(gong)(gong)(gong)合(he)同(tong)(tong)法(fa)(fa)》第(di)十六條(tiao) 勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)由用(yong)人(ren)(ren)單(dan)位(wei)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)協(xie)商一(yi)致,并經(jing)用(yong)人(ren)(ren)單(dan)位(wei)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)在勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)文(wen)本(ben)上簽字或(huo)者(zhe)蓋章生效。勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)文(wen)本(ben)由用(yong)人(ren)(ren)單(dan)位(wei)和(he)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)各執一(yi)份(fen)。第(di)十七(qi)條(tiao) 勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)應當具備以(yi)下條(tiao)款(kuan)(kuan): (一(yi))用(yong)人(ren)(ren)單(dan)位(wei)的(de)名稱、住所(suo)和(he)法(fa)(fa)定(ding)代表人(ren)(ren)或(huo)者(zhe)主要負責(ze)人(ren)(ren); (二)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)的(de)姓名、住址和(he)居民身份(fen)證或(huo)者(zhe)其(qi)他(ta)(ta)有效身份(fen)證件號碼; (三)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)期限; (四)工(gong)(gong)(gong)作(zuo)內容和(he)工(gong)(gong)(gong)作(zuo)地點; (五(wu))工(gong)(gong)(gong)作(zuo)時(shi)間和(he)休息休假(jia); (六)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)報酬; (七(qi))社會保(bao)險; (八(ba))勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)保(bao)護(hu)、勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)條(tiao)件和(he)職業危害防(fang)護(hu); (九)法(fa)(fa)律(lv)、法(fa)(fa)規規定(ding)應當納入勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的(de)其(qi)他(ta)(ta)事項。 勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)除前款(kuan)(kuan)規定(ding)的(de)必備條(tiao)款(kuan)(kuan)外,用(yong)人(ren)(ren)單(dan)位(wei)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)可以(yi)約定(ding)試用(yong)期、培訓(xun)、保(bao)守秘密、補充保(bao)險和(he)福利待遇等其(qi)他(ta)(ta)事項。
