企業辭退試用期員工需要具備什么條件?

答(da) 勞動(dong)(dong)合(he)同(tong)(tong)(tong)中(zhong),對(dui)試用(yong)(yong)(yong)期解約的(de)規(gui)(gui)定有限制,企業對(dui)勞動(dong)(dong)者(zhe)不(bu)(bu)(bu)能說(shuo)辭就辭。勞動(dong)(dong)法規(gui)(gui)定,試用(yong)(yong)(yong)期用(yong)(yong)(yong)人單(dan)(dan)位(wei)(wei)可解除勞動(dong)(dong)合(he)同(tong)(tong)(tong)的(de)情形只有以下幾種: 1、在試用(yong)(yong)(yong)期間被證明(ming)不(bu)(bu)(bu)符合(he)錄用(yong)(yong)(yong)條(tiao)件的(de); 2、重違反用(yong)(yong)(yong)人單(dan)(dan)位(wei)(wei)的(de)規(gui)(gui)章制度的(de);嚴(yan)重失職(zhi),營私舞弊,給用(yong)(yong)(yong)人單(dan)(dan)位(wei)(wei)造(zao)成重大損害的(de); 3、勞動(dong)(dong)者(zhe)同(tong)(tong)(tong)時(shi)與其他用(yong)(yong)(yong)人單(dan)(dan)位(wei)(wei)建立(li)勞動(dong)(dong)關系,對(dui)完成本(ben)單(dan)(dan)位(wei)(wei)的(de)工(gong)(gong)作(zuo)任(ren)務(wu)造(zao)成嚴(yan)重影(ying)響(xiang),或者(zhe)經用(yong)(yong)(yong)人單(dan)(dan)位(wei)(wei)提(ti)出(chu),拒(ju)不(bu)(bu)(bu)改正的(de); 4、因《勞動(dong)(dong)合(he)同(tong)(tong)(tong)法》第二(er)十六(liu)條(tiao)第一款第一項規(gui)(gui)定的(de)情形致使勞動(dong)(dong)合(he)同(tong)(tong)(tong)無效的(de);被依法追究刑事(shi)責(ze)任(ren)的(de); 5、勞動(dong)(dong)者(zhe)患(huan)病或者(zhe)非因工(gong)(gong)負傷(shang),在規(gui)(gui)定的(de)醫療期滿后不(bu)(bu)(bu)能從(cong)事(shi)原工(gong)(gong)作(zuo),也不(bu)(bu)(bu)能從(cong)事(shi)由用(yong)(yong)(yong)人單(dan)(dan)位(wei)(wei)另行安排的(de)工(gong)(gong)作(zuo)的(de);勞動(dong)(dong)者(zhe)不(bu)(bu)(bu)能勝(sheng)任(ren)工(gong)(gong)作(zuo),經過培訓或者(zhe)調(diao)整工(gong)(gong)作(zuo)崗位(wei)(wei),仍不(bu)(bu)(bu)能勝(sheng)任(ren)工(gong)(gong)作(zuo)的(de)。
