 勞(lao)(lao)動合同(tong)中,對(dui)試用(yong)(yong)期解約的(de)規(gui)定(ding)有限制,企業對(dui)勞(lao)(lao)動者(zhe)(zhe)不(bu)(bu)能(neng)(neng)(neng)(neng)說辭就(jiu)辭。勞(lao)(lao)動法規(gui)定(ding),試用(yong)(yong)期用(yong)(yong)人(ren)單位(wei)(wei)可解除勞(lao)(lao)動合同(tong)的(de)情(qing)形(xing)只有以下幾種:   1、在試用(yong)(yong)期間被證明不(bu)(bu)符合錄(lu)用(yong)(yong)條件的(de);   2、重(zhong)違(wei)反(fan)用(yong)(yong)人(ren)單位(wei)(wei)的(de)規(gui)章制度的(de);嚴重(zhong)失職,營私舞弊,給(gei)用(yong)(yong)人(ren)單位(wei)(wei)造成重(zhong)大損害(hai)的(de);   3、勞(lao)(lao)動者(zhe)(zhe)同(tong)時與其他用(yong)(yong)人(ren)單位(wei)(wei)建立勞(lao)(lao)動關系(xi),對(dui)完(wan)成本單位(wei)(wei)的(de)工(gong)(gong)作(zuo)任(ren)務造成嚴重(zhong)影響,或(huo)者(zhe)(zhe)經用(yong)(yong)人(ren)單位(wei)(wei)提出,拒(ju)不(bu)(bu)改正的(de);   4、因《勞(lao)(lao)動合同(tong)法》第(di)(di)二十(shi)六條第(di)(di)一款第(di)(di)一項規(gui)定(ding)的(de)情(qing)形(xing)致(zhi)使勞(lao)(lao)動合同(tong)無效的(de);被依法追(zhui)究刑事責任(ren)的(de);   5、勞(lao)(lao)動者(zhe)(zhe)患病或(huo)者(zhe)(zhe)非因工(gong)(gong)負傷,在規(gui)定(ding)的(de)醫療期滿后不(bu)(bu)能(neng)(neng)(neng)(neng)從事原(yuan)工(gong)(gong)作(zuo),也不(bu)(bu)能(neng)(neng)(neng)(neng)從事由用(yong)(yong)人(ren)單位(wei)(wei)另(ling)行安排的(de)工(gong)(gong)作(zuo)的(de);勞(lao)(lao)動者(zhe)(zhe)不(bu)(bu)能(neng)(neng)(neng)(neng)勝任(ren)工(gong)(gong)作(zuo),經過(guo)培訓或(huo)者(zhe)(zhe)調整工(gong)(gong)作(zuo)崗位(wei)(wei),仍不(bu)(bu)能(neng)(neng)(neng)(neng)勝任(ren)工(gong)(gong)作(zuo)的(de)。
