企業不與員工簽書面合同,會受到什么懲罰?
問 我在濟南(nan)工作,來公司(si)一年(nian)了,還沒和我簽合同(tong),雖然(ran)工資都是按時發放,心里(li)總感覺沒有保障,如果企業不(bu)與(yu)員工簽書面(mian)勞動合同(tong),會不(bu)會受到懲(cheng)罰(fa)?
答 《勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)法(fa)》規(gui)定(ding),用人單(dan)(dan)(dan)位自用工之(zhi)日起超過一個月不滿一年未(wei)與(yu)勞(lao)(lao)(lao)動(dong)者訂立書(shu)面勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)的,應(ying)當(dang)向(xiang)勞(lao)(lao)(lao)動(dong)者每月支(zhi)付(fu)(fu)二倍的工資;用人單(dan)(dan)(dan)位違反本(ben)法(fa)規(gui)定(ding)不與(yu)勞(lao)(lao)(lao)動(dong)者訂立無固定(ding)期限勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)的,自應(ying)當(dang)訂立無固定(ding)期限勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)之(zhi)日起向(xiang)勞(lao)(lao)(lao)動(dong)者每月支(zhi)付(fu)(fu)二倍的工資。因此(ci),單(dan)(dan)(dan)位如果未(wei)依法(fa)與(yu)勞(lao)(lao)(lao)動(dong)者訂立勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong),除應(ying)向(xiang)勞(lao)(lao)(lao)動(dong)者支(zhi)付(fu)(fu)其(qi)應(ying)得(de)的工資以外,還需(xu)再支(zhi)付(fu)(fu)一倍的工資作為對(dui)勞(lao)(lao)(lao)動(dong)者的補償。
