企業不與員工簽書面合同,會受到什么懲罰?

我在濟南(nan)工作,來公(gong)司一年了,還沒和我簽(qian)合同,雖(sui)然工資(zi)都是按時發放,心(xin)里總感覺沒有保障,如(ru)果企業不(bu)與員(yuan)工簽(qian)書面勞動合同,會不(bu)會受到懲罰?

《勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法》規(gui)定,用人單(dan)位自(zi)用工之日起超過一個月不(bu)(bu)滿一年(nian)未(wei)與(yu)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)訂立書面(mian)勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)的(de),應(ying)當向(xiang)(xiang)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)每月支(zhi)付(fu)(fu)二倍(bei)(bei)的(de)工資(zi);用人單(dan)位違反本法規(gui)定不(bu)(bu)與(yu)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)訂立無固(gu)定期限(xian)勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)的(de),自(zi)應(ying)當訂立無固(gu)定期限(xian)勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)之日起向(xiang)(xiang)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)每月支(zhi)付(fu)(fu)二倍(bei)(bei)的(de)工資(zi)。因此,單(dan)位如(ru)果未(wei)依法與(yu)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)訂立勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong),除應(ying)向(xiang)(xiang)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)支(zhi)付(fu)(fu)其應(ying)得(de)的(de)工資(zi)以外,還需(xu)再支(zhi)付(fu)(fu)一倍(bei)(bei)的(de)工資(zi)作為對勞(lao)動(dong)(dong)(dong)(dong)者(zhe)的(de)補償。
