試用期離職還需要交違約金嗎?

我是一(yi)名會計師,正(zheng)在(zai)濟南一(yi)家(jia)(jia)超市工(gong)作,現在(zai)還在(zai)試(shi)用(yong)期,單(dan)位里家(jia)(jia)太遠了,想(xiang)換份工(gong)作,試(shi)用(yong)期離職(zhi)還需要交違約(yue)金嗎?

答(da) 《勞動(dong)(dong)(dong)法》第三十二條(tiao)之(zhi)規定,勞動(dong)(dong)(dong)者(zhe)在(zai)(zai)試用(yong)期(qi)內可(ke)以(yi)隨時通知用(yong)人(ren)單位解除(chu)勞動(dong)(dong)(dong)合同。勞動(dong)(dong)(dong)法賦予了勞動(dong)(dong)(dong)者(zhe)試用(yong)期(qi)隨時解除(chu)勞動(dong)(dong)(dong)合同的(de)(de)權(quan)力(li),且該(gai)解除(chu)權(quan)是無條(tiao)件的(de)(de)。用(yong)人(ren)單位在(zai)(zai)勞動(dong)(dong)(dong)合同中約定勞動(dong)(dong)(dong)者(zhe)在(zai)(zai)試用(yong)期(qi)解除(chu)合同需(xu)承擔違約責(ze)任實際上限制(zhi)了勞動(dong)(dong)(dong)者(zhe)的(de)(de)解除(chu)權(quan),因此該(gai)約定侵害(hai)了勞動(dong)(dong)(dong)者(zhe)的(de)(de)合法權(quan)利,違反(fan)了法律(lv)的(de)(de)規定,應當確認為無效條(tiao)款。
