《勞動合同法》有沒有規定勞動者的辭職自主權?

答 《勞(lao)(lao)動(dong)(dong)(dong)合同(tong)法》第37條規(gui)定(ding):勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)提前30日(ri)以書面形式(shi)通知(zhi)用(yong)人單(dan)位,可(ke)(ke)以解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)。 這里,對(dui)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)是(shi)否(fou)需(xu)要(yao)(yao)合適的(de)(de)理由沒有明(ming)確規(gui)定(ding)。也就是(shi)說,該條規(gui)定(ding)實際上確認了(le)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)合法的(de)(de)自主辭職權(quan)。勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)根據(ju)自身情況或者(zhe)(zhe)個(ge)人發展需(xu)要(yao)(yao),需(xu)要(yao)(yao)解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)的(de)(de),只要(yao)(yao)提前30日(ri)以書面形式(shi)通知(zhi)用(yong)人單(dan)位,即可(ke)(ke)以解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)。 但是(shi),如果勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)因個(ge)人原因解(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)違(wei)反了(le)勞(lao)(lao)動(dong)(dong)(dong)合同(tong)中的(de)(de)相關約(yue)定(ding),構成(cheng)違(wei)約(yue),則還應(ying)承擔相應(ying)的(de)(de)違(wei)約(yue)責任(比如關于(yu)服務期的(de)(de)約(yue)定(ding))。
