《勞動合同法》有沒有規定勞動者的辭職自主權?

我年前找了一份新工(gong)作(zuo),感覺自己不(bu)適合,想辭(ci)職(zhi),勞(lao)動者有辭(ci)職(zhi)自主權嗎?

《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同法(fa)》第(di)37條規(gui)定(ding)(ding):勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者提前(qian)(qian)30日以(yi)書面形(xing)式通(tong)知(zhi)用人單(dan)位(wei),可以(yi)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同。 這里,對勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者是(shi)否(fou)需(xu)要(yao)合(he)(he)適(shi)的理由沒有明(ming)確規(gui)定(ding)(ding)。也(ye)就是(shi)說,該條規(gui)定(ding)(ding)實際(ji)上確認了(le)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者合(he)(he)法(fa)的自(zi)主(zhu)辭(ci)職權。勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者根(gen)據(ju)自(zi)身情況或者個(ge)人發展需(xu)要(yao),需(xu)要(yao)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同的,只要(yao)提前(qian)(qian)30日以(yi)書面形(xing)式通(tong)知(zhi)用人單(dan)位(wei),即可以(yi)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同。 但是(shi),如(ru)果勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者因(yin)個(ge)人原因(yin)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同違(wei)反了(le)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同中的相(xiang)關約定(ding)(ding),構(gou)成違(wei)約,則還應承擔相(xiang)應的違(wei)約責任(比如(ru)關于服務(wu)期的約定(ding)(ding))。
