新員工試用期可以延長嗎?

答(da) 試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)是可以(yi)(yi)(yi)延長的(de),前提是:遵(zun)循(xun)平等自(zi)愿(yuan)、協(xie)商一致(zhi)原(yuan)則。 《勞(lao)(lao)動(dong)法(fa)(fa)》第17條規定:訂立和(he)變更勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong),應當遵(zun)循(xun)平等自(zi)愿(yuan)、協(xie)商一致(zhi)原(yuan)則,不得(de)違反法(fa)(fa)律、行政(zheng)法(fa)(fa)規的(de)規定。如果(guo)用(yong)(yong)(yong)(yong)人單位希(xi)望延長勞(lao)(lao)動(dong)者的(de)試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi),首先要遵(zun)循(xun)協(xie)商一致(zhi)的(de)原(yuan)則,取得(de)勞(lao)(lao)動(dong)者的(de)同(tong)(tong)意。如果(guo)勞(lao)(lao)動(dong)者予以(yi)(yi)(yi)拒絕(jue),單位不能(neng)隨意延長試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)。即(ji)使雙方同(tong)(tong)意延長,最(zui)長也不能(neng)超(chao)過6個(ge)(ge)月,且(qie)合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)在(zai)6個(ge)(ge)月以(yi)(yi)(yi)下(xia)(xia)的(de),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)不得(de)超(chao)過15日;合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)在(zai)6個(ge)(ge)月以(yi)(yi)(yi)上1年以(yi)(yi)(yi)下(xia)(xia)的(de),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)不得(de)超(chao)過30日;合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)在(zai)1年以(yi)(yi)(yi)上2年以(yi)(yi)(yi)下(xia)(xia)的(de),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)(qi)不得(de)超(chao)過60日。
